Abstract
- The article discusses the rules of compensation for the loss of small chances under the Belgian and French Tort Law. It explains the Belgian doctrine of the loss of chance and its application in different domains. The requirements for the application of the loss of a chance theory including proof of conditions of negligence linked to damage and a reasonable likelihood of materialization are elaborated.
