Abstract
- The article discusses the arguments the Court of Justice of the European Union (CJEU) advances for the draft accession agreement to conflict with European Union (EU) law into an accession agreement. It explores a path to European Court of Human Rights (ECHR) accession that values autonomy and effectiveness as constitutional concerns common to all ECHR Contracting Parties. The effects of ECHR accession on the EU constitutional system are also tackled.
