Abstract

The article focuses on the role of the work of Nobel laureate James Buchanan on education played in the formation and evolution of his constitutional thinking. It mentions Buchanan's constitutional economics always considered as a tool for social and political change and decisions of the U.S. Supreme Court to desegregate public schools. It also mentions emergence of the Samaritan dilemma in the context of student unrest in the early 1970s.
