Abstract

The article discusses how sovereign immunity protects the U.S. federal government from its obligations under the Fair Credit Reporting Act. Also cited are the 2019 case Robinson v. U.S. Department of Education in which the Supreme Court failed to grant a certiorari to address the contrasting ruling by the Fourth and Seventh circuits regarding the issue of waiver of sovereign immunity, and why there is a need to reform the Act.
