Abstract

The article provides an overview of the history, main causes of action, significant cases and future of environmental justice (EJ) litigation in the U.S. It mentions the consideration of environmental racism cases as equal protection or due process violations of the Constitution by early EJ plaintiffs. It cites the focus of majority of National Environmental Policy Act (NEPA) EJ litigation on EJ assessments in the permitting process. Also explored are EJ cases under state EJ statutes.
