Problems of transportation of biological materials.

Based on the analysis of the state of the legislation in the field of transportation of biomaterials, a conclusion is drawn about its fragmented nature and it is proposed to form legal provisions that ensure the harmonization of the rules for the transportation and carriage of biomaterials and consolidate the specifics of the transportation of biological goods. The conditions for the application of the Civil Code of the Russian Federation and the corresponding charters and codes to the transportation of biomaterials shall be determined. The relationship between the concepts of 'transportation' and 'carriage' of cargo shall be established, and in relation to biomaterials it shall be proposed to legally distinguish between them. The place of the norms on the transportation of biomaterials in the system of their legal regime shall be revealed and the necessity of legal consolidation of the system of interrelated agreements that ensure the circulation of biomaterials as information carriers shall be substantiated. The features of the subjects of the contract for the biomaterials carriage shall be characterized, the role of SNIPs and special acts in the establishment of auxiliary actions of an organizational nature and additional obligations of the participants in the carriage shall be outlined, measures shall be determined to strengthen control during the biomaterials carriage.
