Abstract

The jury initially declined to award damages to two plaintiffs in the case because they released claims against the defendants in a loan modification agreement. On appeal, the defendants argued that the plaintiffs' ECOA claims fell outside of the applicable statute of limitations, that the trial court provided erroneous jury instructions, and that the two plaintiffs originally denied damages should be subject to the loan modification release.
