Abstract
- This document provides an overview of the ongoing litigation surrounding the NCAA's rules on Name, Image, and Likeness (NIL) rights. Judge Claudia Wilken has certified three separate classes of plaintiffs in cases filed by past and present NCAA Division 1 student-athletes against the NCAA and several conferences. Previous cases, such as the Ed O'Bannon case, have found the NCAA's rules to violate antitrust laws, and the Supreme Court has affirmed that the NCAA is subject to antitrust law. As a result, student-athletes across the country are now receiving compensation for the use of their NIL. The NCAA is seeking legislation to limit NIL benefits and give student-athletes special status.
