Abstract

A recent study conducted by researchers at the Icahn School of Medicine at Mount Sinai examined medical malpractice litigation involving orbital fractures. The study found that orbital fractures often require surgical intervention and can be a source of medical litigation due to the complexity of the reconstruction. The researchers reviewed 49 cases from 1994 to 2018 and found that the most common legal complaint was a failure to diagnose the fracture correctly. While almost half of the cases favored the defendant, cases that were decided in favor of the plaintiff resulted in significant compensatory damages, with some exceeding $100,000.
