Companies implement pre-arbitration procedures, batching protocols, and mandatory settlement conferences to manage mass arbitration. These strategies have implications for claimants, as they may face delays and increased complexity in seeking relief, potentially transforming arbitration beyond the scope of the Federal Arbitration Act.
