Abstract

The article discusses the withdrawal of a subpoena by federal prosecutors in New York to the American Civil Liberties Union to retrieve all copies of a classified document. The prosecutors grounded their action on changed circumstances, although a transcript of a closed hearing suggested that the government was going to lose the case. The document subject of the subpoena was not confidential and collected a number of policies concerning photographs of enemy prisoners of war.
