Abstract

The article discusses the paper “The disclosure of source code in software patents: Should software patents be open source?,” by Kenneth Canfield which appeared in the “Columbia Science & Technology Law Review.” The paper reports on the U.S. Patent and Trademark Office and the Federal Circuit's conclusion that written description and best mode do not require the disclosure of code. It also recommends a requirement to disclose code due to the nature of software development.
