Abstract

The article discusses oral advocacy in U.S. legal proceedings as of June 2012, focusing on the distinctions between civil law and common law methods of legal reasoning in regards to oral arguments. The American stare decisis legal doctrine is addressed, along with an analysis of the hierarchical relationship between the various levels of courts in the U.S. It states that civil law codes evolved from the "Corpus Juris Civilis" by Emperor Justinian I.
