Abstract

The article discusses capacity for lifetime and estate planning in the U.S. as of March 2013, focusing on attorney-client relationships, capacity standards, and various legal documents such as durable powers of attorney. Wills, trusts, and health care powers of attorney are addressed, along with living wills and a survey of American College of Trust and Estate Counsel (ACTEC) members. Mental capacity and health care proxies are mentioned, as well as contractual capacity.
