Abstract

This article reports on the failure of a legislation that would establish special courts for environmental cases to gain governmental support in India. The novel legal response to environmental crime was shaped by the former Chief Justice P.N. Bhagwati, who hoped that the new courts would make it easier for injured parties to receive compensation and restitution. Indian companies and owners can shield themselves from criminal and financial responsibility by using a front man to take the fall. Also, the regular courts are slow, and judges often do not have the expertise needed to deal with the evidence.
