Abstract
- The author notes that on August 15, 2013, the U.S. Advisory Committee on Civil Rules has proposed new amendments to the Federal Rules of Civil Procedure, which have attracted much controversy from the legal community because of their stricter emphasis on proportionality in the civil discovery process. He predicts that the proposed revision to Civil Procedure Rule 37(e), which advocates the implementation of a uniform standard for spoliation sanctions, will have a major impact on litigation.
