Abstract

Bosnia and Herzegovina as a state is still in the process of constitution. Instead of finding “true measure” building a vision, responsibility, value system, identity, tolerance and human and national dignity, the accent has been placed on various interpretation of its legal nature, the form of government, rule and political system, especially the cause, character and effects of „tragic conflict in the region”, hence it is necessary to objectively establish the truth and come to agreement in terms of establishing the final model of Bosnia and Herzegovina as a state. The author has also considered the constitutionalisation of the consitutional law institute of constituency of peoples and constitutional law position of nationals and „others” including possible scope, content and character of constitutional changes in terms of the European court for Human Rights Decision, which creates the obligation for Bosnia and Herzegovina to amend its constitution and electoral legislation with the aim to lift discrimination of any kind and form. It includes ali consitutional law and other assumptions for equity and equality of „others” according to standards and criteria guaranteed by international, regional and internal documents. However, all this does not waive other constitutional provisions which would brought into guestion the existing constitutional law government of Bosnia and Herzegovina, based on the Deyton solutions and established principle of representation of constituent peoples and „others” in government bodies and institutions at all levels, which, inter alia, represents condicio sine qua non for its existence, sustainability stability and development.
