Abstract
- The article explores the impact of the Supreme Court decision in SFFA v. Harvard on voluntary affirmative action programs. It discusses the history of affirmative action in higher education, highlighting landmark Supreme Court cases such as Bakke and Grutter. The article then focuses on the SFFA v. Harvard case and its implications for private employers. It argues that challenges to voluntary affirmative action programs in the private sector are unlikely to succeed due to the strength of Title VII and previous Supreme Court precedents.
