Abstract

The context of new European realities is mapped first by the disappearance of internal borders within the European Union, and, secondly, by the necessity for Member States to use the most efficient judicial means and tools to fight the crime phenomenon, in order to create a common space of freedom, security and justice. Since the European Arrest Warrant plays a major role within the pale of the above mentioned judicial instrumentation, this paper aims both to achieve a series of conceptual boundaries on the translation into Romanian legislation of the provisions of Framework Decision 2002/584/JHA of the European Union Council, and to conduct a rigorous analysis of the relevant judicial practice of both national and community courts.
