Abstract
- The article presents the author's insights regarding the argument of professor Daniel Statman that value and moral concerns are involved in halakhic ruling. The author remarks that Statman is right in his claim, with considerations to the effects of halakhic issues on state policy. Meanwhile, the author points out the source of the moral and value considerations constituting the normative domain of the Jews which are antecedent to or independent of halakha. Moreover, the author mentions that the argument of Statman did not lead to a condition where anything goes, considering that the value and moral considerations described from the tradition of the Jews allow a big conclusion set.
