The article discusses a court case of Gomez v. Rossi Concrete, Inc. wherein construction workers filed class action based on several issues including inter alia, non payment of minimum wages under the California law and breach of fiduciary duties under the U.S. Employee Retirement Income Security Act. The plaintiffs filed for class certification and the U.S. district court granted plaintiff's motion in part and denied in part.
