Abstract

The article focuses on the proposals for reform of the law on the procedural provision associated with incapacity which affects an accused during his trial, and the mental illness defence. It mentions that these legal provisions protects the individuals accused of criminal offences, and abuse of court process. It highlights the citations of cases including Eastman v. The Queen, R v. Mailes, and R v. Kesavarajah.
