Abstract

The article discusses the concept of remedial judicial discretion in relation to constitutional adjudication in America, focusing on the attitudes of U.S. Supreme Court Justices Antonin Scalia, Clarence Thomas, and John Roberts in regards to the case Brown v. Plata which deals with injunctions, prison overcrowding in California, and the Eighth and Fourteenth Amendment to the U.S. Constitution. Dissenting opinions, prisoner releases, and non-retroactivity doctrines are also examined.
