La libertad de expresión: perspectiva desde el ordenamiento jurídico español

Freedom of expression has been in our legal system since the beginning of the constitutional era, evolving until reaching the current regulation of this right, enshrined as fundamental in Article 20 of the Spanish Constitution and supported by the European Convention on Human Rights. This work is an analysis of freedom of expression from the constitutional framework, as well as from the European legal framework, where it is analyzed from the Strasbourg test, used as a method by the Court to prosecute restrictions on the right in question, in addition to jurisprudence of this Court regarding freedom of expression in European legislation. On the other hand, the limits that freedom of expression has at the national level are also exhaustively analyzed when confronted with other fundamental rights, it’s digital frontier and freedom of the press as part of it, which includes an analysis of the World Press Freedom Ranking in 2021. La libertad de expresión lleva en nuestro ordenamiento jurídico desde los inicios de la época constitucional, evolucionando hasta llegar a la actual regulación de este derecho, consagrado como fundamental en el artículo 20 de la Constitución Española y solidarizado por el Convenio Europeo de Derechos Humanos. Este trabajo es un análisis sobre la libertad de expresión desde el marco constitucional, así como desde el marco jurídico europeo, donde se analiza desde el test de Estrasburgo, utilizado como método por el Tribunal para enjuiciar las restricciones al derecho en cuestión, además de jurisprudencia de este Tribunal referente a la libertad de expresión en la legislación europea. Por otro lado, se analizan también de manera exhaustiva los límites que tiene la libertad de expresión en el ámbito nacional cuando confrontan con otros derechos también fundamentales, su frontera digital y la libertad de prensa como parte de la misma en la que se incluye un análisis de la clasificación Mundial de la Libertad de Prensa en 2021.
