Children life story in residential care: searching of the marks of participation

A presente dissertação alicerça-se num dos princípios fundamentais da Convenção sobre os Direitos da Criança, especificamente o direito de participar e ser ouvida nos processos judiciais ou administrativos, nomeadamente quando as crianças são colocadas em situações de vulnerabilidade. Nesta linha, pretende-se a partir da história de vida de cada criança caraterizar a sua participação, primeiramente, num processo judicial ou administrativo, e depois, na Casa de Acolhimento; por outro lado, identificar o motivo pelo qual a criança é acolhida e compreender o significado que a Casa de Acolhimento tem para as crianças participantes no estudo. Para alcançar este objetivo, procedeu-se a uma recolha de dados pertinentes, numa Casa de Acolhimento que recebe crianças em situações de vulnerabilidade, situada no concelho de Braga. A investigação assumiu um caráter qualitativo/interpretativo, inspirando-se nos pressupostos no método de estudo de caso, com recurso a entrevistas semiestruturadas com sete crianças, a um adulto e ainda à análise documental de documentos orientadores do acolhimento de crianças e jovens, realizadas no respeito pelas normas e garantias éticas a seguir na investigação, especialmente no caso de pesquisa com crianças. Os resultados revelam que as crianças têm sido ouvidas nos processos judiciais ou administrativos, apesar de ainda existirem dificuldades na definição e enquadramento institucional de alguns aspetos muito específicos, como, por exemplo, a avaliação de níveis de maturidade, em função da idade. Todavia, a maioria das crianças refere que conhece os reais motivos da sua retirada de casa. Para a superação dos problemas e para a abertura de novos horizontes de vida para as crianças torna-se, então, crucial a intervenção dos técnicos de acolhimento residencial na ajuda à reconstrução de laços afetivos, indispensáveis ao desenvolvimento integral da criança, bem como à promoção de medidas que construam com as crianças dinâmicas mais participadas nos seus mundos de vida.
This dissertation is based on one of the fundamental principles of the Convention on the Rights of the Child, specifically the right to participate and be heard in judicial or administrative proceedings, particularly when children are placed in situations of vulnerability, often in the family context, which directly or indirectly affect their integral development. In this line, it is intended from the life history of each child to characterize their participation, first, in a judicial or administrative process, and then, in the Residential Care; On the other hand, to identify the reason why the child is welcomed, and to understand the meaning that the Residential Care has for the children participating in the study. In order to achieve this objective, a data collection was collected, in a Residential Care that receives children in situations of vulnerability (physical maltreatment, school absenteeism, lack of family back-up, parental incompetence, leaks household), located in the county of Braga. The research assumed a qualitative/interpretative character, inspired by the methodological assumptions in the case study method, using semi-structured interviews with seven children, an adult and also the documentary analysis of documents guiding the reception of children and young people, carried out carried out in the Ethical standards to be followed in research, especially in the case of research with children. The results show that children have been heard in judicial or administrative proceedings, although there are still difficulties in defining and institutional setting some very specific aspects, such as the evaluation of maturity levels, according to age. However, most children report that they know the real reasons for their removal from home. In order to overcome problems and open up new horizons for children, it is therefore crucial for the intervention of the reception staff to assist in the reconstruction of affective bonds, which are essential for the integral development of the child, as well as for the promotion of measures that they build with the most dynamic children participating in their worlds of life.
