Şer'iyye sicillerine göre 1650-1750 yıllarında Konya'da çocuklar ve yetimler

Tarih boyunca çocuklar, toplumun en zayıf kesimini oluşturmuşlardır. Bu durum onların, haklarının ihlal edilmesine ve hor görülmelerine neden olurken dolaylı olarak da, fiziksel ve ruhsal gelişimlerini olumsuz yönde etkileyerek topluma kazandırılmalarına engel oluşturmuştur. Bu hususta İslâm hukuku, bireye verdiği önem ile çocuğun bedensel ve ruhsal gelişimini, bunun yanı sıra da haklarını koruma altına almaya çalışmıştır. Osmanlı Devleti de, fıkıhtaki hüküm ve uygulamalardan yola çıkarak çocuğun her açıdan korunması için uğraşmıştır. Fakat çocukla ilgili mevcut çalışmaların Tanzimat Fermanı'ndan sonra olması nedeniyle Osmanlı Devleti'nin klasik döneminde çocuğun toplumdaki konumu ve çocukla ilgili İslâm hükümlerinin ne derece uygulandığı hususu belirsiz kalmıştır. Dolayısıyla bu tez çalışmasında, çocuğun İslâm ve Osmanlı hukukundaki hakları, bakımı, himâyesi, çocuğa yönelik işlenen suçlar ve sicillere yansıyan çeşitli konular incelenerek Konya örneği üzerinden Osmanlı toplumunda çocuğun konumu ve hukukî durumu tespit edilmeye çalışılacaktır.
Throughout history, children have formed the weakest segment of society. This situation while they cause their rights to be infringed and despised; indirectly, they have been prevented to gain to the community by the negative impact on physical and psychological development. In this respect, Islamic law has tried to protect the physical and spiritual development of the child, as well as his rights, with the importance given by the individual. The Ottoman Empire also strived to protect the child in every respect, based on good judgments and practices in Islamic law. However, since the current studies on children are after the Rescript of Gülhane, the position of the child in society in the classical period of the Ottoman State and case of the extent to which Islamic provisions concerning children are being applied remains uncertain. Therefore, in this thesis study, the position and rights of the child in the Ottoman society will be tried to be determined through the example of Konya by examining crimes committed against the child and the various issues reflected in the records and the rights, care and guardianship of the child in Islamic and Ottoman law.
