From the Protection of the Environment to the Recognition of 'Natura' as a Legal Subject. A Review of the Categories of Civil Law?

RESUMEN: El artículo aborda los avances que se han logrado en la ciencia jurídica en materia de tutela del medio ambiente. Resalta las diferentes declinaciones existentes en relación con la interpretación del artículo 9.° de la Constitución italiana, los cambios en el alcance de los principios de responsabilidad y de precaución, y las categorías de los bienes. Y finalmente el artículo concluye con una mención sobre el abandono de la concepción antropológica del derecho. ABSTRACT. The paper addresses the changes occurred in the study of environmental protection. Specific attention is reserved to the interpretation of article 9 of the Italian Constitution, the rising principles of responsibility and precaution, the developments in property law, and the setting of the anthropological conception of law.
