Le nouveau Code civil brésilien : changements culturels et permanence dans la protection des relations familiales

La révision du Code civil brésilien concernant la protection des relations familiales impose de connaître les transformations sociales qui ont suscité un regain d’intérêt pour l’idée de codification. Répondre, dans une société pluraliste, aux besoins de constance, d’adaptabilité et d’universalité du droit s’avère un grand défi. Le désordre normatif et jurisprudentiel qui touchait le droit de la famille justifiait-il l’adoption d’un nouveau code pour organiser la société brésilienne ? La loi a-t-elle finalement réussi à établir un équilibre entre les anciennes règles concernant le mariage et la parenté et les nouveaux principes constitutionnels qui organisent la société ? Il semble intéressant de présenter la recodification du droit de la famille au Brésil, tout en se demandant dans quelle mesure le nouveau code brésilien aura permis de clarifier et d’unifier le droit concernant la protection de la vie familiale.
The revision of the Brazilian Civil Code with regard to the protection of family relations makes necessary the need to know the social transformations that have stimulated renewed interest in the concept of codification. In a pluralistic society, rising to answer the needs in substantive law for consistency, adaptability and universality is indeed a considerable challenge. Did the normative and jurisdictional confusion that affected family law justify the adoption of a new code to organize Brazilian society ? Has substantive law finally succeeded in striking a balance between the former rules concerning marriage and parental relations, and the new constitutional principles that organize society ? It seems interesting to present the re-codification of family law in Brazil, while dwelling on the question to what extent the new Brazilian Code will have made it possible to clarify and unify the legal concepts underlying the protection of family life.
