PARTICIPATION OF 'ANOTHER' PERSON AS THE DEFENDER IN THE PERFECT PRODUCTION

The article examines the notion of "defender" in criminal proceedings, as well as persons who can act as defenders: lawyers, close relatives and "other" persons. The opinion of researchers and judicial practice on the issues of the right of participation of "other" persons as defenders at pre-trial stages of criminal proceedings is considered. The argument is given of the possibilities and the need to extend this right.
В статье рассматривается понятие «защитник» в уголовном судопроизводстве, а также лица, которые могут выступать в качестве защитников: адвокаты, близкие родственники и «иные» лица. Рассматривается мнение исследователей и судебная практика по вопросам права участия «иных» лиц в качестве защитников на досудебных стадиях уголовного судопроизводства. Даётся аргументация возможности и необходимости расширения этого права.
