Abstract

El objetivo de esta investigación es analizar la técnica legislativa del Soft Law aplicada en la Declaración Universal de los Derechos Humanos y en la Declaración Americana de los Derechos y Deberes del Hombre. La investigación es descriptiva y se utiliza la técnica de la observación documental. Se concluye que el Soft Law constituye una técnica legislativa que ha permitido la creación de directrices no vinculantes a seguir por los Estados en la regulación de los derechos humanos a los fines de facilitar la suscripción de tratados internacionales para resguardar derechos inherentes al individuo. The objective of this investigation is to analyze the legislative technique of the Soft Law applied to the Universal Declaration of Human Rights and the American Declaration of the Rights and Duties of Man. The research is descriptive and uses documentary observation. Conclusions were that the Soft Law constitutes a legislative technique that has permitted the creation of non-binding directives to be followed by the States in the regulation of human rights aiming to facilitate subscription to international treaties that protect inherent individual rights.
