Regime of exploitation of the land and legal status of the peasants in the Principality of Catalonia and Kingdom of Valencia in the Low Middle Ages

Con este estudio que se halla enmarcado dentro de la línea seguida por el ilustre historiador del Derecho Eduardo de Hinojosa y Naveros se pretende analizar las relaciones sociales y fuerzas productivas imperantes en el Principado de Cataluña y en Reino de Valencia durante la Baja Edad Media. Para ello, centramos el estudio en el estatus jurídico de los campesinos –libres y serviles- y su relación con los señores territoriales y, en consecuencia, la problemática jurídica en torno a la propiedad del suelo y al régimen jurídico de tenencia y explotación de la tierra (enfiteusis) como principal medio de producción del régimen feudal medieval en ambos territorios de la Corona de Aragón. The purpose of this study, that is framed within the line followed by the ilustrious historian of Law Eduardo de Hinojosa y Naveros is to analyze the social relations and productive forces from a juridical perspective on time, in Catalonia (Principado de Cataluña) and in the Kingdom of Valencia in the late Middle Ages. To this end, we focus the study on the legal status of paying attention to the legal problems concerning land ownership and the legal system of tenure and the land management system (emphyteusis), the main productive resource at that time in all those territories.
