European Union’s stance towards the Syrian crisis: constraints and incoherences of European external action in the Mediterranean

Hasta el estallido de la denominada “primavera árabe” en los primeros meses de 2011, la Unión europea había mantenido una política exterior condescendiente ante las vulneraciones graves y masivas de los derechos humanos responsabilidad del régimen sirio dirigido por el clan de los Al-Assad. Como respuesta al conflicto armado sirio y la comisión de crímenes contra la humanidad y crímenes de guerra atribuibles al Gobierno sirio, la UE ha aplicado toda una batería de medidas restrictivas, y ha destinado un volumen notable, aunque insuficiente, de ayuda humanitaria para atender las necesidades básicas de los refugiados y desplazados internos. La actuación llevada a cabo ante la crisis siria, ha evidenciado tanto las limitaciones como las incoherencias que presenta la acción exterior de la UE, en el contexto del fracaso de la política euromediterránea desarrollada por las instituciones de la UE durante los últimos 20 años. Como mejor receta para corregir estas limitaciones e incoherencias, cabe propugnar que la acción exterior de la UE se base en el estricto cumplimiento del ordenamiento internacional, y más en particular en la defensa de la aplicación de sus principios estructurales. Until the outbreak of the “Arab Spring” during the first months of 2011, EU’s External Policy had been condescending towards the serious and massive violations of human rights committed by the Syrian regime under the Al-Assad clan. As a response to the Syrian armed conflict and to the commission of crimes against humanity and war crimes attributed to the Syrian Government, the EU has adopted a package of restrictive measures and has allocated a significant, yet insufficient, volume of humanitarian aid to attend to the essential needs of refugees and internal displaced persons. EU’s action in response to the Syrian crisis has demonstrated not only the constraints but also the incoherences of EU’s External Policy in a context of failure of the Euro-Mediterranean Policy developed by the institutions throughout the last twenty years. Therefore, the best prescription for the correction of the said constraints and incoherences shall be that EU’s External Policy be underpinned by the strict compliance with international law, specifically, by the defence of the application of its structural principles.
