Abstract

V magistrskem delu je obravnavana problematika urejanja pravnega statusa občinskih javnih cest v primerih dejanskih razlastitev. Gre za primere izgradnje, splošne uporabe in kategorizacije občinskih cest na zemljiščih, ki so v zasebni lasti. Na ta način je lastnikom zemljišč dejansko onemogočena uporaba in uživanje nepremičnine in jim preostane le še gola lastninska pravica. Tovrstni posegi v lastninsko pravico niso dopustni in za lastnike zemljišč pomenijo dejansko razlastitev. V takem primeru mora krajevno pristojna občina zaradi odprave nezakonitega stanja na spornih nepremičninah pridobiti lastninsko pravico. Občina lahko lastninsko pravico pridobi s sklenitvijo pravnega posla ali z izvedbo postopka razlastitve, v kolikor so za to izpolnjeni zakonsko predpisani pogoji. V magistrskem delu je predstavljen razvoj reševanja problematike urejanja pravnega statusa občinskih javnih cest. Na podlagi sprejetih pravnih aktov in obsežne sodne prakse so obravnavane različne dileme in pravna vprašanja. Predstavljen je tudi nov institut aktivne legitimacije za razlastitvene zavezance, ki naj bi pripomogel k odpravi nezakonitih stanj. The master's thesis examines the issue of the regulation of legal status of municipal public roads in case of (wrongful) de facto expropriation. It refers to the cases of construction, general use and categorisation of municipal roads established on private land. In this way, the landowners are effectively prevented from using and enjoying the property, and all they are left with is a bare ownership right. The above-listed interferences with ownership right are wrongful and represent a de facto expropriation for the landowners. In such a case, the municipality with territorial jurisdiction must acquire ownership right in order to remedy the unlawful state of the property at issue. The municipality may acquire ownership right by concluding a legal transaction or by carrying out the expropriation procedure, in so far as the statutory conditions are met. The master's thesis presents the development of approaches towards solving the problem of the regulating of the legal status of municipal public roads. On the basis of valid legal acts and extensive case law, various dilemmas and legal issues are addressed. Also presented is a new institute of standing to bring proceedings, granted to persons liable to expropriation (landowner), which should help to eliminate unlawful states.
