Yurtdışına çalıştırılmak üzere götürülen Türk işçilerin iş hukuku bakımından korunması

Uluslararası ilişkilerdeki artışa bağlı olarak ülkeler arasındaki işçi hareketleri de artmaktadır. Türk işçiler, 1957 yılından itibaren imzalanan ikili anlaşmalarla, 1972 yılından itibaren de işverenler aracılığı ile yurtdışına çalışmak üzere gitmektedir. Türk işçilerin yoğun biçimde yurtdışında istihdam edilmeleri, bu işçilerin karşılaştıkları problemleri ve korunma ihtiyacını da arttırmıştır. Yabancı ülkede çalışan Türk işçileri koruma görevi Anayasanın 62 nci maddesi uyarınca Devlet'e verilmiştir. Devlet, bu görev dolayısıyla bir takım düzenlemeler yapmış ancak bu düzenlemeler işçileri korumakta yetersiz kalmıştır. Yurtdışında çalıştırılan işçilerin yeterince korunamaması, yurtdışı iş sözleşmelerinden kaynaklanan uyuşmazlıkları arttırmış, uyuşmazlıklara uygulanacak hukukun tespiti konusu tartışmalara neden olmuştur. Mahkemelerin, kamu düzeni gerekçesiyle her uyuşmazlığa Türk hukukunu uygulaması, işverenlerin ekonomik olarak zarar görmesine yol açmış, işverenler yurtdışından aldıkları iş oranı artmasına Türk işçi istihdamından vazgeçmeye başlamıştır. Çalışmamız ile yurtdışına çalışmak üzere götürülen Türk işçilerin korunmaya ihtiyaç duydukları alanlar ve yurtdışı iş ilişkilerinde karşılaşılan problemlere ilişkin çözüm önerilerine yer verilmiştir. Labour movements across countries increase depending on the improvements in international relations. Turkish workers have gone abroad to work with the bilateral agreements that have been signed since 1957 and with the assistance of employers since 1972. Large number of Turkish workers being employed overseas has increased the problems these workers face and the necessity of protection. The role of protecting these Turkish workers has been given to the Turkish Government as per article 62 of the Constitutional Law. The Government has made a set of adjustments due to this role but these adjustments have fallen short of protecting the workers.The fact that overseas Turkish workers cannot be protected sufficiently has increased the conflicts arising from overseas employment contracts, and the subject of determination of the law for these conflicts has caused controversy. The court's decision to implement Turkish law for every conflict has resulted in economic damage for employers. Despite these employers recruiting more people from overseas, they have started reducing the number of Turkish workers they employ. In this study, we have included the areas in which Turkish workers who were taken abroad to work need to be protected and proposed solutions for the problems that are faced in international labour relations. 199
