PERLINDUNGAN HUKUM TERHADAP PENGETAHUAN TRADISIONAL PADA ERA MASYARAKAT EKONOMI ASEAN (MEA) DAN IMPLIKASINYA BAGI BANGSA INDONESIA

The purpose of this study was to analyzing about the reasons for the importance of traditional knowledge is protected by law and analyzing and assess the implications a rising from the law protection for traditional knowledge. This writing method of research is doctrinal legal research (doctrinal) or normative, who studied law as a norm. While the views of the data source is a doctrinal or normative research. Data analysis technique used is content analysis (content analysis). In the era of the ASEAN Economic Community (AEC) which is currently underway, then traditional knowledge should be protected by law because of law protection of traditional knowledge is closely related to the transfer of science and technology, economic growth and the dignity of the nation, to encourage investment in research and development. Law protection of the traditional knowledge have strategic value. The implications posed by the existence of legal protection of traditional knowledge, among others, can be recognized by other nations as a nation that respects and maintaining traditional knowledge systems, increased utilization of traditional knowledge and may be one factor driving the increase in revenues, employment opportunities so as to reduce unemployment and will increase people's purchasing power caused by rising per capita income of the people. Suggestions author of the government and the House of Representatives it is time to initiate an Act or other legislation on traditional knowledge, which set it comprehensively and realized through a special system to better regulate traditional knowledge can accommodate the nature and character of traditional knowledge. Governments should cooperate with other relevant agencies doing data collection efforts (data base) and repertoire (treasury) on traditional knowledge belonging to the nation.
