Abstract

It is said that the requirements of acceptability for merit judgement is comprehended into the General Legal Process Theory as it is the Civil Law Process, the Penal Legal Process and the Labor Legal Process in which each of them has its own written legal regimen that is properly codified and formulated according to its specificity. This article is based on the concepts of classical doctrine and intends both to present new views, which have been developed by the modern doctrine, and to show that there has been an academic evolution as well as make the studious people reflect on this evolution. This article, based on the concept of part, not only study the reflection of this concept on the legal process presupposition and the legal action conditions but also analyze other elements that comprise this process institutions, which are together the requirements needed by the magistrate to judge the meritum causae.
