Abstract

A combination of health care enterprise liability and binding arbitration could be a cost-effective way of dealing with medical malpractice. Making the enterprise liable would also make sense in an era when health care is increasingly delivered through health maintenance organizations. Respondeat superior would be one possible theory of liability for a health care enterprise. A combination of mediation and voluntary binding arbitration to resolve disputes would save money and entail far less emotional stress for all parties than litigation does.
