Abstract
- A look at the first WTO case involving the use of the General Agreement on Tariffs and Trade Article XXIV on the justification of Brazil's import ban on retreaded tires in the context of preferential trade agreement is presented. The dispute has tangled environmental and health measure with an Article XXIV defense. The applicability of the Article XXIV exception is also discussed.
