La protección del trabajador a través de la presunción legal de accidente de trabajo

Siendo nítida la comprensión acerca de qué es un accidente de trabajo, los problemas surgen cuando debemos comprobar si la situación concreta real se ajusta o no a aquel concepto. A través del presente fijamos nuestra mirada en la presunción de accidente de trabajo contenida en el artículo156.3 de la LGSS para examinar, a la luz de los problemas reales concretos, la concurrencia de los presupuestos legales que dan vida a la presunción y cómo ésta actúa con mayor vigor cuando la patología que presenta el trabajador está relacionada con problemas cardíacos. La interpretación judicial es clave para conocer cuál es el grado de intensidad en que han de aparecer los requisitos que conforman la citada presunción, a saber: “durante el tiempo y en el lugar del trabajo”.
Being clear the understanding about what an accident at work is, the problems arise when we must check whether or not the real concrete situation fits that concept. We set our sights on the presumption of work accident contained in art. 156.3 LGSS to examine –in the light of the real concrete problems– the concurrence of the legal presuppositions that give life to the presumption and how it acts with greater vigor when the pathology presented by the worker is related to heart problems. Judicial interpretation is essential to know with what intensity the presuppositions that give life to the presumption must be presented, that is, what we have to understand by “during time and in the workplace”.
