Viviendas de uso turístico y vías actuación de la comunidad de propietarios

Halako gaiak ez dira baketsuak jurisprudentzian, ezta doktrinan ere. Gaia oso konplexua da jabetza horizontalean dauden interes ezberdinak modu orekatuan uztartu nahi direlako. Horretarako, lanaren edukia zati ezberdinetan banatu da. Hasteko, erabilera turistikoko etxebizitzengatik sor daitezkeen ala sortzen diren arazoak behar bezala ulertzeko, jarduera horren arazoak zehaztu nahi dira eta halako arazoek Zuzenbide zibilean dakartzaten ondorioak ere. Bigarrenik, legegilearen erantzunaren beharra nabarmentzen da. Jarraian, erabilera turistikoko etxebizitza zer den zehaztuko da, bere izaera juridikoa, araubide aplikagarria, horretarako antzeko figuren azterketa erabiliz. Lan honen oinarrizko zati bezala, ordenamendu juridikoak eskaintzen dituen bideak zehaztuko dira jabeen erkidegoak erabilera turistikoko etxebizitzen jardueraren aurka egin ahal izateko. Amaitzeko, lanaren zati bakoitzetik atera ditudan azken ondorioak sartuko dira.
In this paper we analyze the different possibilities that community of owners within their reach to act against the damages caused by the so-called houses for tourist use (VUT). It is about issues that have not been peaceful neither for the jurisprudence nor for the doctrine by how complex it is to conjugate the adequate balance of the different interests that converge in the horizontal property. To do this, the body of work is divided into several blocks. First of all, for elucidate the scope of the problems that VUTs generate or may generate as activity, we will try to objectify said problem and the consequences that it has in civil law (II), and, in the following section, the need for a response by part of the legislator (III). Next, in order to answer the fundamental question of what a VUT is, both its legal nature and the possible applicable regime, using for this the analysis of the different related figures (IV). As a fundamental part of this work, an attempt will be made to establish what are the the ways offered by the legal system so that the community of owners can act against the VUT (V). Finally, it will include the synthesis that has been collected from each block, formulating the final conclusions.
En el presente trabajo se analizan las diferentes posibilidades que tiene la comunidad de propietarios a su alcance para actuar frente a los menoscabos ocasionados por las denominadas viviendas de uso turístico (VUT). Se trata de cuestiones que no han sido pacíficas ni para la jurisprudencia ni para la doctrina por lo complejo que resulta conjugar el adecuado equilibrio de los diferentes intereses que confluyen en la propiedad horizontal. Para ello, el cuerpo del trabajo se divide en varios bloques. En primer lugar, para dilucidar el alcance de los problemas que generan o pueden generar las VUT como actividad, se tratará de objetivar dicha problemática y las consecuencias que tiene en el Derecho civil (II), y, en el siguiente apartado, la necesidad de respuesta por parte del legislador (III). A continuación, con el fin de responder a la fundamental cuestión de qué es una VUT, se analizará tanto su naturaleza jurídica como el posible régimen aplicable, empleando para ello el análisis de las diferentes figuras afines (IV). Como parte fundamental de este trabajo, se procurará establecer cuáles son las vías que ofrece el ordenamiento jurídico para que la comunidad de propietarios pueda actuar frente a las VUT (V). Por último, se incluirá la síntesis que se haya colegido a partir de cada bloque, formulando las conclusiones finales.
