Mecanismos de coordinación y cooperación entre la justicia penal ordinaria y la justicia indígena

In this context, the objective that was raised in the investigation was to analyze the mechanisms of coordination and cooperation between ordinary criminal justice and indigenous justice of Ecuador, in Ecuadorian regulations and jurisprudence. The applied methodology was descriptive documentary type. As a result, it was obtained that there is a contention between the justice systems since when carrying out indigenous justice, processes are followed in ordinary justice, framing the crime of kidnapping for the members of indigenous peoples, altering the articles of the law in against jurisdictional functions, resulting in the lack of cooperation and coordination mechanisms due to the subordination of systems.
En este contexto, el objetivo que se planteó en la investigación fue analizar los mecanismos de coordinación y cooperación entre la justicia penal ordinaria y la justicia indígena del Ecuador, en la normativa y jurisprudencia ecuatoriana. La metodología aplicada fue de tipo descriptiva documental. Como resultado se obtuvo que existe una contienda entre los sistemas de justicia puesto que al llevar a cabo la justicia indígena se siguen procesos en la justicia ordinaria, enmarcando el delito de secuestro para los integrantes de los pueblos indígenas, alterando los artículos de la ley en contra de las funciones jurisdiccionales, resultando la falta de mecanismos de cooperación y coordinación por la subordinación de sistemas.
