This article focuses on the EU (European Union) greenhouse gas emission allowance trading directive. The ET Directive has put in place a regulatory framework for the implementation of a compulsory greenhouse gas allowance trading scheme in all the EU Member States, from 1 January 2005 onwards, in order to promote reductions of greenhouse gas emissions in a cost-effective and economically efficient manner. The first phase of this Directive will take place between 2005 and the end of 2007. According to the Directive, the operators of installations which undertake the activities covered by Annex I of the ET Directive must hold allowances for all emissions of the greenhouse gases listed in Annex II of that Directive.

European Community environmental policy should, according to the Treaty, be based on certain environmental principles. It is clear that there is an obligation on the institutions in this regard, yet the nature of the obligation is unclear. There has, in particular, been dispute as to whether non-adherence to the principles in secondary legislation may result in the annulment of that legislation by the Court of Justice. The manner in which the Court has used the environmental principles as aids to interpretation has also lacked coherence. It is argued here that judicial use of the environmental principles is both legitimate and consistent with the Court's general adjudicative methods. On this basis, judicial consideration of the principles, particularly in a way that clarifies their scope of application, is to be encouraged, not least as a way in which the courts can respond to environmental aspects of cases before them. The Case C-176/03 Commission v Council, European Court of Justice: May 26, 2005, concerns the correct legal basis of criminal environmental law under European Law. In directives and regulations the Community legislator can adopt provisions with regard to criminal law measures if it is necessary to achieve a Community objective. In the case Case C- 416/02 Commission v Spain, European Court of Justice: May 12, 2005, Spain was found to be in contravention of the Waste Framework Directive by failing to ensure that waste from a large pig farm in Almeria, Spain was properly disposed of without endangering human health or the environment.
