This article explores open access (OA) business models within the context of scholarly information networks in the U.S. Open access journals do not provide a significant solution to scholarly information distribution concerns. While OA publication may seem like a great idea, there are reasons why OA journal articles are not the right approach to distributing scholarly information. First, there is a fatal flaw in the pricing model of OA. Interest in maintaining the same support for peer-reviewed material is not equal within the revenue base. The majority of authors willing to support some form of scholarly publication reside in academia. However, many readers are located in commercial organizations having little interest in altruistic support if the information can be obtained freely through OA. In addition, OA would also mean the loss of subsidies that support the maintenance and development of long-term archives. OA would create a system more like HighWire, with reliance upon annual subscriptions to support OA infrastructures. There would once again be even greater reliance on fewer annual contributors. As a business model, the reliance on fewer vested and altruistic supporters to maintain archiving is also not practical.

This article analyzes the Technology, Education and Copyright Harmonization (TEACH) Act in the U.S. The bill allows educators to freely use copyrighted works in distance education. The act contains several qualifications that prospective institutions and educators must meet in order to limit copyright. Three of qualifications are called the educational nexus qualifications, which basically say that you have to be a teacher in a school, making use of the copyrighted work directly and primarily for educational purposes in order to use the TEACH Act. The nexus qualifications have a prerequisite: the schools this seeks to limit must be accredited and non-profit. The fourth major qualification concerns copyright policy: each school that wishes to use the TEACH Act must have a policy that notifies students or other eligible users of the responsibilities and the copyright owner's rights. Congress has limited the eligibility and scope of the TEACH Act to specific institutions, namely schools and governmental bodies. This limitation is the foundation for the educational nexus qualifications. Section 110 says that a performance or display of a copyrighted work must be made and supervised by an instructor as part of a class session offered as a regular part of the activities of a governmental body or accredited non-profit educational institution.
