Abstract

The success of the New York Convention has made arbitration a preferred means of dispute resolution for international commercial transactions. Success in arbitration often depends on the extent to which a party may secure assets, evidence, or the status quo between parties prior to the completion of the arbitration process. This makes the availability of provisional measures granted by either arbitral tribunals or by courts fundamental to the arbitration process. In this Article, I consider the existing legal framework for provisional measures in aid of arbitration, with particular attention to the sources of the rules providing for such measures. Those sources include the New York Convention, the applicable lex arbitri, the institutional arbitration rules, and the arbitration agreement. I consider whether these sources provide a comprehensive and coherent framework for the availability of provisional measures. I then consider some of the ways in which the arbitration clause may be drafted to specifically take into account the often unanticipated, but always possible, need for provisional measures, providing ten rules for consideration of provisional measures when drafting an arbitration agreement. Abstract

The paper discusses empirical Bayes methodology for repeated quality comparisons of health care institutions using data from the Dutch VOKS study that annually monitors the relative performance and quality of nearly all Dutch gynecological centres with respect to different aspects of the childbirths taking place in these centres. This paper can be seen as an extension of the pioneering work of Thomas, Longford and Rolph and Goldstein and Spiegelhalter. First of all, this paper introduces a new simple crude estimate of the centre effect in a logistic regression setting. Next, a simple estimate of the expected percentile of a centre given all data and a measure of rankability of the centres based on the expected percentiles are presented. Abstract

Objective. To determine changes in peri- and neonatal care concerning neonatal mortality and morbidity by comparing 2 cohorts of very prematurely born infants (gestational age [GA] Methods. The Leiden Follow-Up Project on Prematurity (LFUPP-1996/97), a regional, prospective study, includes all infants who were born alive after a GA Results. The absolute number of preterm births in the study region increased by 30%: 102 in 1983 to on average of 133 in 1996-1997. Centralization of perinatal care improved: the percentage of extrauterinely transported infants decreased from 61% in 1983 to 35% in 1996-1997. A total of 182 (73%) of the LFUPP-1996/97 infants were treated antenatally with glucocorticosteroids compared with 6 (6%) of the POPS-1983 infants. A total of 112 (42%) of the LFUPP-1996/97 infants received surfactant. In-hospital mortality decreased from 30% in the 1980s to 11% in the 1990s. Mortality of the extremely preterm infants ( Conclusions. An increase in the absolute number of very preterm births in this study region was found, leading to a greater burden on the regional NICUs. Improvements in peri- and neonatal care have led to an increased survival of especially extremely preterm infants. However, increased survival has resulted in more morbidity, mainly bronchopulmonary dysplasia, at the moment of discharge from the hospital.
