Historically, the establishment of Protected Areas (UC's), part of Brazilian environmental policy, has constituted a face of the conflictive relationship between traditional peasant and indigenous communities and urban-industrial society UC's were implanted, especially from the 1950s, on territories historically occupied by traditional and original populations and became another factor in transforming the territoriality of these communities, which already suffered from the advance of the agricultural frontier and the modernizing project of the period. The struggle for territory, associated with a part of the environmental movement, led to the conquest of some rights, including access to land, through protected areas of sustainable use. However, environmental policy has been used to solve territorial issues and has therefore been a mediator of the territorialities of peasant communities. In this article we discuss how the establishment of protected areas tends to replace land policies, analyzing the contradictions that arise from the mediation of access to the traditional territory for environmental conservation, and we argue that this trend has been constituting at the same time a strategy for maintenance of the Brazilian agrarian structure. A balanced environment is a right of all, and both society and public authorities must safeguard it. Considering the responsibilities of the Public Administration, this study aims to understand how environmental protection policies can also contribute to increase municipal revenue. The relevance lies in the search to demonstrate that environmental actions conducted by municipalities can improve the quality of life of its citizens and increase tax revenue via the Ecological ICMS; thus, investing in other areas such as infrastructure, public safety, health and education. The Ecological ICMS is one of the criteria for distributing the ICMS share that states must transfer to the municipalities. Regarding the methodology adopted, this is a descriptive study with a qualitative approach. In addition to consulting the literature, analyzing laws, documents, and official websites, interviews were conducted to achieve the results. This is a case study of the municipality of Niterói, RJ. The results obtained prove that environmental policies can also be financially advantageous, especially for municipalities that do not receive a large amount when considering the other ICMS distribution criteria. The BR 101 is a very important road for the country and have suffered duplication works to decrease the number of traffic jams and accidents along its length. The stretch between km 190.3 to km 144.2 pierces a Conservation Unit (UC) and an Environmental Protection Area (APA), areas where biodiversity must be preserved, and its legal support by Law 6938/8, National Environmental Policy. Eleven environmental impacts were identified caused by this project and evaluated through a matrix of interaction. The impacts were negative and reveal a worrying situation because of permanent damage to the ecosystem adjacent, which can affect the populations of fauna and flora. [ABSTRACT FROM AUTHOR]

The business sector is promoting a change in its management model, since the early 90s, when it took a positive attitude toward the environment. Thus, environmental issues have become part of the strategic planning of organizations due to stricter regulations and to society's demands for greater environmental responsibility. Therefore, this study aims to identify and analyze environmental practices adopted by companies of this sector in Goiás and to seek answers to questions related to the factors that can contribute to the creation of competitive advantages within these organizations. Organizations involved in that study are labeled A, B, C and D. This research has used the fundamentals of qualitative and exploratory approach and it can be characterized as a field research. In the growing and processing of sugar cane, certainly negative impacts to the environment are still present. However, adoption of actions mentioned here, as the search for the conservation of soil and vegetation, replacing the burned by harvesters, the rational use of chemicals, the recycling of waste in the production process (such as power generation through bagasse sugarcane), among others, point out benefits to business sector and the environment. Preservation of the environment is one of the main social concerns of the XXI century. This includes finding alternatives that can provide future generations with an environment that permits the continuity of human life. The present qualitative study involved discussions about collective awareness of issues including environmental sustainability and the need to develop new ways to create targeted policies. Adolescents participating in the "Saber Cuidar" project were encouraged to understand the meaning and importance of environmental education, and the creation of a system of peer group environmental education was encouraged. This study was undertaken in a State school, southeast of the city of São Paulo, with the participation of twelve students aged between 11 and 12 years. Data were collected using interviews and participant observation. Four themes emerged from the analysis: ecological awareness, social transformation, difficulties with the implementation of the proposal, and achievement of the proposed environmental education. The main results showed the importance of environmental awareness during the educational process, and of encouraging the perception of students concerning the environment in which they live. The work revealed a need to build new types of interaction able to raise perception of educational and social problems, which might then favor constructive action to stimulate necessary social mobilization. The students who participated in this study were encouraged to pass their acquired knowledge to their peers, and to teach others about environmental issues. [ABSTRACT FROM AUTHOR]

This study, holding as background the conflicts that involve the environment, analyzes the fraternity principle, from the perspective of the theory proposed by Baggio, concluding that the official pattern of environmental litigations composition that exist in Brazil --solidified by the obsolete monopoly of Judiciary-- consolidated on a Law's positivism and on a competitive point of view of the society, does not contemplates the fraternity as a legal value. In other hands, the paper starts to focus the mediation, making clear that this alternative way of contest's solution not only disposes with justness to the environmental conflicted issue but --remarkably by its communicative characteristic acting and shared true-- deeply excited by the fraternity idea. The subject has been researched in the specialized literature, making sure about the precarious systematization of the mediation as management way of environmental conflicts, as well as a lack on the approach of the fraternity as juridical category of potential incidence at the environmental field. In the end, the analysis concludes that the eco mediation may appease the insertion of the fraternity component on arguing related to environmental estates, generally ruled by the radicalization and a vision of world's representationalism, contributing perhaps to the co-operation construction of a new paradigmatical systemic epistemology for conflicts solutions, that insures the emphasized roll to fraternal as imperative of conduct. O Parque Estadual da Cantareira (PEC) é uma Unidade de Conservação de Proteção Integral criada através do decreto n° 41.626/63, atualmente gerenciado pela Fundação Florestal órgão vinculado a Secretaria de Estado do Meio Ambiente. Possui 7.916,52 hectares e abrange parte dos municípios de São Paulo, Mairiporã, Caieiras e Guarulhos é um dos últimos remanescentes de Mata Atlântica, rico em mananciais e que abriga diversas espécies de fauna e flora ameaçadas de extinção. Por estar inserido em uma das maiores metrópoles urbanas do mundo sofre com as pressões provenientes de uma sociedade em expansão como: a ocupação urbana desordenada, despejos irregulares de lixo, caça predatória, incêndios e invasões de moradores do entorno para as mais diversas finalidades, que colocam em risco a integridade da Unidade prejudicando assim nosso objetivo maior que é o de conservar os recursos naturais oferecidos pelo PEC para as atuais e futuras gerações. A fim de minimizar a degradação o PEC elaborou o Projeto Cuca, uma estratégia de Conservação que vem agindo na comunidade de seu entorno através de parcerias com as associações de bairro e diversos atores da comunidade desenvolvendo atividades de sensibilização e mobilização ambiental e assim a conseqüente conservação desta área. The Judiciary also has the basic duty of protecting the environment. Starting from this premise and using the inductive method, the article discusses the legitimacy of judicial intervention in the implementation of the fundamental ecological duties that are constitutionally assigned to Public Administration. The article is justified due to the lack of specific studies relating the judicial control of public policies with environmental issues, the increasing judicialization of environmental disputes and the strong controversy this issue still raises. It concludes that the Judiciary should be an institutional partner in the task of implementing environmental policies and that its active intervention is legitimate in case of omission by government agencies or officials. As agressões ao meio ambiente, num contexto de esgotamento de recursos naturais, vêm recebendo crescente importância aos olhos da sociedade e, nesse cenário, o meio ambiente passou a ser protegido pelo Direito Penal. Assim, muitas destas agressões, como a poluição, passaram a ser qualificadas como crimes ambientais tornando se necessária a produção de prova técnica para o seu devido julgamento. Este trabalho apresenta uma nova estratégia para caracterização de crimes ambientais de poluição e correlatos baseado em abordagem multiparamétrica. Para isso foram utilizadas análises de diferentes parâmetros como metais, razões de isótopos estáveis e compostos orgânicos (hidrocarbonetos aromáticos policíclicos), e análise estatística multivariada, com o intuito de obter uma assinatura química robusta dos poluentes da fonte suspeita e assim estabelecer correspondência com os mesmos parâmetros determinados no compartimento ambiental receptor. Ainda, foram incorporados alguns conceitos de metrologia, como o cálculo de incerteza de amostragem, conforme preceituam as novas tendências de desenvolvimento conceitual e metodológico das ciências forenses. Os sedimentos de um curso dágua altamente impactado por descargas diversas foram o objeto das investigações como sendo o compartimento receptor e o percolado de um aterro de resíduos industriais perigosos envolvido em um crime ambiental foi analisado como possível fonte. A abordagem multiparamétrica utilizada neste trabalho proporcionou uma melhor discriminação dos pontos de coleta com base na sua localização com relação às fontes de poluição por meio da Análise de Componentes Principais e as análises de metais realizadas nos sedimentos permitiram caracterizar um crime de poluição ambiental. As estimativas de incerteza de amostragem evidenciaram variações nos resultados principalmente decorrentes da heterogeneidade da distribuição dos contaminantes no meio o que implica que as incertezas devem, preferencialmente, ser estimadas e reportadas nas medições no âmbito forense para um efetivo apoio às tomadas de decisões nelas baseadas. The aggressions to the environment in a context of depletion of natural resources have been receiving increasing attention in the eyes of society; therefore, the environment became protected by criminal law. For this reason, many assaults, such as pollution, were classified as environmental crimes, generating the need for scientific evidence to be used in the due judgment of these crimes. This paper presents a new method for characterization of environmental pollution and related crimes based on a multiparameter approach. This approach employs the analysis of different parameters such as metals, stable isotope ratio and organic compounds such as polycyclic aromatic hydrocarbons, and statistical techniques of multivariate analysis in order to obtain a robust chemical signature of the suspected source pollutants and then establish correspondence with the same parameters determined in the affected environmental compartment. In addition, some concepts of metrology were incorporated, such as uncertainty of sampling, as demanded by the conceptual and methodological trends in the development of forensic sciences. Watercourse sediments highly impacted by various discharges were investigated as the pollution sink and the leachate from a landfill of hazardous industrial waste involved in an environmental crime was analyzed as a possible source. The multiparameter approach used in this study provided a better discrimination of sampling points based on their location with respect to sources of pollution with the principal components analysis. The metal analysis in sediments allowed the characterization of a pollution crime in the studied stream. The estimates of uncertainty of sampling showed large variations in the results mainly arising from the heterogeneity of the distribution of contaminants in the environment. Hence, the uncertainties should preferably be estimated and reported in the forensic measurements to provide an effective support to decision making.

The Extractive Reserve , which is evident by the law 9.985/2000 is an area of public domain to be used by traditional extractive populations whose livelihood is based on the extractivism and, additionally , on subsistence agriculture and breeding of small size, and has as objective protect the livelihoods and culture of these populations , and to ensure the sustainable use of natural resources unit ( BRAZIL , 2000) . Thus , to see this issue more closely , we chose this survey in the State of Sergipe , especially in the estuarine zone of Piauí and Fundo rivers , covering streams and fragile ecosystems of Municipalities Itaporanga D´Ajuda, Indiaroba and Santa Luzia Itanhy in whose areas is being made possible the possibility of creating and implementing the Extractive Reserve of the South Coast . Had as objective to evaluate conflicts of use / appropriation locked around the process of implementing the Extractive Reserve of the south coast of Sergipe . The methodological approach to structure the research in question was developed through analysis of landscape units . In order to characterize the social actors involved in the data collection procedure , the instruments of interviews and literature were used . For both , this search was structured through a qualitative and quantitative approach , guided by the analysis of landscape units . Finally , it is reiterated that this research did not seek the development of absolute truths but rather a scientific knowledge grounded in previously defined methodology. At the end of the research and preparation of this thesis, it was realized that the established territorial conflicts around the deployment process RESEX South Coast of Sergipe configures multiple territories that affect the social actors involved in the process from appropriation by actors social engaged in commercial activities, and social reappropriation of space by traditional communities. Produced and exposed results in this thesis can serve for the agents involved in the conflicts themselves as a material awareness and self-criticism , assisting in the search for ways to mediate conflicts . A Reserva Extrativista, pelo que se depreende da lei 9.985/2000 é uma área de domínio público que deve ser utilizada por populações extrativistas tradicionais, cuja subsistência baseia-se no extrativismo e, complementarmente, na agricultura de subsistência e na criação de animais de pequeno porte, e tem como objetivos básicos proteger os meios de vida e a cultura dessas populações, e assegurar o uso sustentável dos recursos naturais da unidade (BRASIL, 2000). Desse modo, para se enxergar mais de perto tal questão, optou-se por esta pesquisa realizada no Estado de Sergipe, sobretudo na zona estuarina dos rios Piauí e Fundo, abrangendo cursos D Água e ecossistemas frágeis dos Municípios de Itaporanga D Ajuda, Estância, Indiaroba e Santa Luzia do Itanhy, em cujas áreas está sendo viabilizada a possibilidade de criação e implantação da Reserva Extrativista do Litoral Sul . Teve-se como objetivo avaliar os conflitos de uso/apropriação travados em torno do processo de implantação da Reserva Extrativista do Litoral Sul de Sergipe. A abordagem metodológica que estrutura a pesquisa em questão desenvolveu-se através da análise das unidades de paisagem. Visando caracterizar os atores sociais envolvidos, no procedimento de coleta de dados, foram utilizados os instrumentos de entrevistas e pesquisa bibliográfica. Para tanto, tal coleta foi estruturada através de uma abordagem quali-quantitativa, orientada pela análise das unidades de paisagem. Por fim, reitera-se que esta pesquisa não buscou a elaboração de verdades absolutas e sim de um conhecimento científico embasado em metodologia previamente definida. Ao término da pesquisa e elaboração desta dissertação, percebeu-se que os conflitos territoriais estabelecidos em torno do processo de implantação da RESEX do Litoral Sul de Sergipe configuram múltiplas territorialidades que atingem os atores sociais envolvidos no processo a partir da apropriação, por parte de atores sociais envolvidos em atividades comerciais, e Reapropriação social do espaço pelas comunidades tradicionais. Os resultados produzidos e expostos nesta dissertação podem servir para os próprios agentes envolvidos nos conflitos como um material de sensibilização e autocrítica, auxiliando na busca por formas para mediação dos conflitos.

This research analyzed the possibility of characterize the current Brazilian State as an Environmental State and the consequences of this phenomenon. The concern with the environment preservation just began more strongly in the 70´s when the world started to realize the effects of inappropriate use of natural resources. It was recognized, since then, the existence of an environmental crisis that combined with the development phase that the world is, called by Ulrich Beck of risk society, promote the conditions to develop a new State model - the Environmental State - characterized by the insertion of the environmental concern among the governmental objectives. The national doctrine admits the adoption of the Environmental State according to 1988 Constitution because it is written in its text the obligation to protect the environment and as well as the recognition of the ecologically balanced environment as a fundamental right. To endorse this doctrinal position, the research investigated the presence of Environmental State characteristics in the 1988 constitutional text indicating the capable instruments to justify this statement. As the assumption of the existence of a Brazilian Environmental State was proved, the work studied two ways to contribute to the implementation of this new state model: the need for new pre-understandings from the Constitution interpreters as well as the requirement for new behaviors from the government. According to the Hans-George Gadamer philosophical rmeneutics, to understand something it is necessary a preunderstanding of the issue. Thus, to accomplish the Environmental State is necessary, initially, that the Constitution interpreter re-understands the ecological issues. In this sense, this work indicates four necessary pre-understandings to the implementation of the Brazilian Environmental State which are: the environmental crisis, the risk society and the creation of environmental problems, the need for a new relationship between man and nature, the concept of sustainable development and prohibition to retrogress in environmental subjects. In addition, it points out the ways to the Government achieve this new state model. A pesquisa buscou averiguar a possibilidade de se caracterizar o atual Estado Brasileiro como um Estado Ambiental bem como discutir as consequências desse fenômeno. A preocupação com a preservação do meio ambiente iniciou-se de modo mais contundente a partir da década de 70 quando se começou a perceber os efeitos do uso inadequado dos recursos naturais. Reconheceu-se, a partir de então, a existência de uma crise ambiental a qual aliada à fase de desenvolvimento em que o mundo se encontra, denominada por Ulrich Beck de sociedade de risco, acabaram por criar as condições para que se desenvolvesse um novo modelo de Estado - o Estado Ambiental - caracterizado pela inserção da preocupação ambiental entre os objetivos estatais.A doutrina nacional admite a adoção do Estado Ambiental pela Constituição de 1988 em razão de constar em seu texto a obrigação da proteção do meio ambiente bem como de reconhecer o meio ambiente ecologicamente equilibrado como um direito fundamental. Para constatar essa posição doutrinária a pesquisa investigou a presença das cacterísticas de um Estado Ambiental no texto Constitucional de 1988 indicando os dispositivos capazes de fundamentar a afirmação. Confirmada a premissa da existência de um Estado Ambiental Brasileiro o trabalho buscou estudar duas formas de se contribuir para a efetivação desse novo modelo estatal: a necessidade de novas pré-compreensões por parte dos intérpretes da Constituição bem como a obrigatoriedade de novas condutas por parte dos poderes públicos. Segundo a hermenêutica filosófica de Hans-George Gadamer desenvolvida em sua obra Verdade e Método, para compreender algo é necessário antes uma pré-compreensão da questão. Assim, para se efetivar o Estado Ambiental é preciso, inicialmente, que o intérprete da Constituição précompreenda a questão ecológica. Nesse sentido, o trabalho indica quatro précompreensões necessárias à efetivação do Estado Ambiental Brasileiro quais sejam a crise ambiental, a sociedade de risco e as gerações de problemas ambientais, a necessidade de uma nova relação entre o homem a natureza, o conceito de desenvolvimento sustentável e a proibição de retrocesso em matéria ambiental. Além disso, pontua formas do Poder Público concretizar esse novo modelo de Estado.

O trabalho apresenta uma aplicação da ferramenta metodológica conhecida como FMEA (Failure Mode Effect Analysis) ao processo de identificação de aspectos e impactos ambientais. Tal processo é parte importante na implantação e na manutenção de Sistemas de Gestão Ambiental (SGA), baseados na norma NBR ISO 14001. Além disso, pode contribuir, de forma complementar, para a avaliação e aperfeiçoamento da segurança nuclear da instalação analisada. Como objeto de estudo elegeu-se o Centro de Combustíveis Nucleares (CCN) do IPEN/CNEN-SP, localizado junto ao Campus da Universidade de São Paulo-Brasil, destinado à realização de pesquisas científicas e à produção de elementos combustíveis para o Reator IEA-R1. A partir de um levantamento sistemático de dados, obtidos por meio de entrevistas, documentos e registros operacionais foi possível identificar os processos, suas interações e atividades, cuja análise permitiu definir os diversos modos de falhas potenciais, as respectivas causas e conseqüências para o meio ambiente. Como resultado da avaliação criteriosa dos modos causas foi possível identificar e classificar os principais impactos ambientais potenciais, que constitui uma etapa essencial para a implantação e manutenção de um Sistema de Gestão Ambiental para a instalação em estudo. Os resultados obtidos permitiram demonstrar a validade da aplicação da técnica FMEA aos processos de instalações nucleares, identificando aspectos e impactos ambientais, cujos controles são essenciais para a obtenção da conformidade com os requisitos ambientais do Sistema de Gestão Integrada do IPEN (SGI). Contribuíram também para fornecer uma ferramenta gerencial poderosa para a solução de questões relacionadas ao processo de atendimento de exigências legais aplicáveis no âmbito da Comissão Nacional de Energia Nuclear (CNEN) e do Instituto Brasileiro do Meio Ambiente (IBAMA). This work presents an application of Failure Mode Effect Analysis (FMEA) to the process of identification of environmental aspects and impacts as a part of implementation and maintenance of an Environmental Management System (EMS) in accordance with the NBR ISO 14001 standard. Also, it can contribute, as a complement, to the evaluation and improvement of safety of the installation focused. The study was applied to the Nuclear Fuel Center (CCN) of Nuclear and Energy Research Institute (IPEN), situated at the Campus of University of Sao Paulo, Brazil. The CCN facility has the objective of promoting scientific research and of producing nuclear fuel elements for the IEA-R1 Research Reactor. To identify the environmental aspects of the facility activities, products, and services, a systematic data collection was carried out by means of personal interviews, documents, reports and operation data records consulting. Furthermore, the processes and their interactions, failure modes, besides their causes and effects to the environment, were identified. As a result of a careful evaluation of these causes it was possible to identify and to classify the major potential environmental impacts, in order to set up and put in practice an Environmental Management System for the installation under study. The results have demonstrated the validity of the FMEA application to nuclear facility processes, identifying environmental aspects and impacts, whose controls are critical to achieve compliance with the environmental requirements of the Integrated Management System of IPEN. It was demonstrated that the methodology used in this work is a powerful management tool for resolving issues related to the conformity with applicable regulatory and legal requirements of the Brazilian Nuclear Energy Commission (CNEN) and the Brazilian Institute of Environment (IBAMA).

The creation of municipal parks in São Paulo has happened on a spread and less efficient way during this city history. The Olavo Setúbal’s administration (1975-1979), nevertheless, has showed a strong opposite idea to this aforementioned tendency, it has been a period marked by strong investments in this sector. There were several factors that contributed to the policy were successfully taken over by the mayor. The outline proposed here focuses on the influence of O Estado de São Paulo journal in the consolidation of that policy, trying to elucidate an important step in the production of the public space in São Paulo, especially the green areas for leisure and recreation, from their social assumptions and interests involved in them. A criação de parques municipais em São Paulo aconteceu de forma esparsa e pouco eficiente ao longo da história da cidade. A gestão de Olavo Setúbal (1975-1979), no entanto, apresentou um forte contraponto a essa tendência, sendo um período marcado por fortes investimentos no setor. Diversos fatores contribuíram para que a política encampada pelo prefeito obtivesse sucesso. O recorte aqui proposto enfoca a influência do jornal O Estado de São Paulo na consolidação dessa política, buscando elucidar uma etapa importante da produção do espaço público na cidade de São Paulo, em especial as áreas verdes de lazer e recreação, a partir de suas premissas sociais e dos interesses nela implicados.

Assim, é apresentada uma nova perspectiva dos embates sociais. The creation of protected areas is one of the most recurrent environmental politics worldwide. The protection of an area, however, involves different levels of conflict due to the appropriation of environmental resources. This paper analyzes the category of conflicts as a theoretical tool to apprehend the composition of the social agenda. It presents a new perspective of social battles.

Orientador: Emilia Wanda Rutkowski Dissertação (mestrado) - Universidade Estadual de Campinas, Faculdade de Engenharia Civil, Arquitetura e Urbanismo Resumo: As Unidades de Conservação (UCs) são o tipo de área protegida que se configuram como a principal estratégia do poder público para promover a conservação da biodiversidade e recursos naturais à ela associados. A integração dessas unidades à dinâmica territorial, intervindo e alterando-a, quando necessário, é essencial para que sejam cumpridos os seus objetivos de criação. A zona de amortecimento é um dos instrumentos do plano de manejo das UCs que respondem pela integração da unidade ao território. No presente trabalho foram analisados o Sistema Nacional de Unidades de Conservação (SNUC), o Plano Estratégico Nacional de Áreas Protegidas e os planos de gestão do território cujos objetivos e diretrizes influenciam a implementação das zonas de amortecimento. Com a finalidade de entender o isolamento inicial das áreas protegidas no Brasil, foram recuperados os marcos históricos da estruturação político-institucional do Estado brasileiro na área de conservação ambiental: das primeiras ações de proteção dos recursos naturais na época do império até a territorialização da conservação da biodiversidade, que culminou com a criação do Sistema Nacional de Unidades de Conservação (SNUC). Os planos de gestão do território foram apresentados e analisados segundo a perspectiva de integração das UCs aos diversos usos do território. Os critérios para a delimitação física da zona de amortecimento definidos pelo Conselho Nacional de Meio Ambiente (CONAMA) e pelo Instituto Brasileiro do Meio Ambiente e dos Recursos Naturais Renováveis (IBAMA) foram listados e, a partir da legislação analisada, foram discutidos os elementos que elas oferecem para a viabilização das zonas de amortecimento. Abstract: The Conservation Units are a sort of protected area which presents themselves as being the main strategy of the State to promote the maintenance of biodiversity and its natural resources. The integration of these Units into the dynamics of the territory, causing to intervene in and transform it whenever necessary, is essential so that the objectives of their creation are met. The buffering zone is one of the tools of the UCs management plan which is responsible for the integration of a Unity into the territory. In this study, the Conservation Units National System (SNUC), the National Strategic Plan of Protected Areas, as well as the territory management plans, whose goals and policies affect the implementation of the buffering zones, have been analysed. In order to understand the initial isolation of protected areas in Brazil, it was necessary to retrace the historic events which contributed to the political-institutional organization of Brazilian State concerning the realms of environmental conservation: from the first actions taken towards the protection of natural resources at the Empire Age to the =territorialization' of biodiversity conservation, leading to the creation of the Conservation Units National System (SNUC) The territory management plans have been presented and analysed according to the expectations of the UCs integration into the several uses of the territory.The criteria for the setting of the geographical boundaries to the buffering zones established by the Environment National Board (CONAMA) and the Environment and Renewable Natural Resources National Institute (IBAMA) have been listed, and basing on the analysed legislation, the elements they provide for the viability of the buffering zones have been discussed. O presente artigo faz uma avaliação da hidreletricidade no Brasil a partir da sua importância na matriz elétrica do país, do caráter prioritário que a geração hidrelétrica assume na gestão dos recursos hídricos, e dos impasses e controvérsias do ponto de vista social e ambiental decorrentes da implantação e operação dos empreendimentos hidrelétricos. Para ilustrar as questões levantadas com relação às grandes usinas, são referenciados dois estudos de caso - a UHE Tijuco Alto, em processo de licenciamento ambiental pelo Ibama; e a UHE Barra Grande, cujo processo de licenciamento foi marcado por uma série de irregularidades. Por fim, são apontadas possíveis alternativas para a geração hidrelétrica, em particular a repotenciação de usinas e um maior incentivo às pequenas centrais hidrelétricas. This article assesses hydroelectricity in Brazil according to its importance as one of the country’s main energy sources and also to its social and environmental impasses and controversies derived from the implantation and operation of hydroelectric undertakings. In order to illustrate the questions related to large power plants that are brought up along the article, two case reports are presented: Tijuco Alto Hydroelectric Power Plant, which is going through Ibama’s (Brazilian Institute for the Environment and Renewable Natural Resources) environmental license process; and Barra Grande Hydroelectric Power Plant, whose environmental license process has been affected by several irregularities. Finally, possible alternatives for hydroelectric production are pointed out, particularly power plant re-potentiation and a greater incentive to undersized hydroelectric plants.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior The permanent preservation area (PPA) is an area protect by the Brazilian Forestry Code, cover or not with native vegetation, which has the environmental function to preserve water resources, landscape, geologic stability, biodiversity, fauna and flora gene flow, to protect the soil and to assure the human beings welfare. These areas are located in the top of hills, slopes, along rivers, etc, and in that, the natural resources cannot be explored. Despite this, they are being used for agriculture or are degraded and without use. Generally, the area which cannot be explored doesn t have economic value for the producers, so any other use becomes more lucrative. Therefore, is presumed that for agricultural proprietors keep the native vegetation in the areas determined for the legislation it is necessary a kind of economic benefit. As the benefits generated for the maintenance of the PPAs are for all the society, a solution would be the society payment for the protection. Thus, the main objective of the present study was to determine the monetary value of the PPAs of the São Bartolomeu River watershed, through the existence value disclosed by the urban population of the city of Viçosa, state of Minas Gerais. The watershed is located in Viçosa city, in a region called Zona da Mata. The region is characterized by the high concentration of small properties, by step slopes and high incidence of water sources. Because of that, considerable extensions of the region properties are considered of permanent preservation. It was used a method of environmental valuation called contingent valuation (CVM). This method consists in measuring the individual preferences through people s willingness-to-pay (WTP), in this in case, in favor of the recovery or preservation of the watershed s PPAs. It was created a hypothetical market, in which people would pay an additional tax in their water account, to be directed to the recovery or preservation of PPAs. Besides, in order to reduce the underdevelopment bias, the research was complemented by the component of voluntary work, through the willingness-to-work voluntarily (WTWv) in favor of the recovery or preservation of the APPs. It was also evaluate the urban population environmental perception in relation to the forestry legislation and the environmental services of the watershed s PPAs. The data have been collected by means of personal interviews through questionnaires. The elicitation technique that was used to determine the WTP was an adaptation of the referendum method with bidding games. To determine the WTWv, open questions were used so that the interviewed could freely revealed the hours per week that they would dedicate in favor of the voluntary work. It was used the Logit model in order to identify the variables that have influenced the person probability to accept the WTP proposal for the recovery or preservation of the PPAs. The average value of willingness-to-pay was estimated to be R$ 27,98 per month, which results in R$ 3.863.926,08 per year or R$ 3,616.52 per hectare/year for the recovery or preservation of the PPAs of the São Bartolomeu River watershed. The value for WTWv was estimated to be R$ 11.671.249,50 per year, confirming that the introduction of this component increases the monetary value of the permanent preservation areas. Such values can help the establishment of environmental politics that consolidate the effectiveness of the PPAs in rural properties. A área de preservação permanente (APP) é uma área protegida no Código Florestal, coberta ou não por vegetação nativa, com a função ambiental de preservar os recursos hídricos, a paisagem, a estabilidade geológica, a biodiversidade, o fluxo gênico da fauna e da flora, proteger o solo e assegurar o bem-estar das populações humanas. Essas áreas se localizam em topos de morros, encostas, margens de rios, etc; e nelas, os recursos naturais não podem ser explorados. Apesar disso, estão sendo usadas para cultivos agrícolas ou estão degradadas e sem uso. A área intocada geralmente não tem valor econômico para os produtores, tornando qualquer outra forma de uso mais rentável. Desta forma, acredita-se que seja necessário estabelecer alguma forma de benefício econômico para que esses proprietários rurais mantenham a vegetação nativa nas áreas determinadas pela legislação. Como os benefícios gerados pela manutenção das APPs são para toda a sociedade, uma solução seria ela pagar pela proteção. Partindo dessa premissa, o presente estudo buscou determinar o valor monetário das APPs da microbacia do Ribeirão São Bartolomeu, por meio do valor de existência revelado pela população urbana de Viçosa, município da região da Zona da Mata de Minas Gerais, onde está localizada a microbacia. A região é caracterizada pela alta concentração de pequenas propriedades, pelo seu relevo acidentado e pela alta incidência de mananciais hídricos. Isso faz com que extensões consideráveis das propriedades rurais da região sejam consideradas de preservação permanente. Foi utilizado o método de valoração ambiental denominado valoração contingente (MVC), em que se medem as preferências individuais a partir da disposição a pagar (DAP), neste caso, pela recuperação ou preservação das APPs da microbacia. Foi criado um mercado hipotético no qual as pessoas pagariam uma taxa adicional na conta de água para ser direcionada à recuperação ou preservação de APPs. Além disso, a fim de diminuir o viés do subdesenvolvimento, foi incorporado ao estudo o componente da disposição ao trabalho voluntário (DATv) para a recuperação ou preservação das APPs. Aliado a isso, procurou-se também avaliar a percepção ambiental da população urbana em relação à legislação florestal e aos serviços ambientais prestados pelas APPs da microbacia. Os dados foram coletados por meio de entrevistas pessoais com o uso de questionários. A técnica de eliciação utilizada para determinar a DAP foi uma adaptação do método referendum com jogos de leilão; já para a DATv, as questões foram abertas para que os entrevistados manifestassem livremente as horas por semana que estariam dispostos a dedicar ao trabalho voluntário. Foi utilizado o modelo logit para se identificarem as variáveis que influenciavam a probabilidade de os indivíduos aceitarem a DAP proposta pela recuperação ou preservação das APPs. A DAP verdadeira mensal média obtida foi de R$ 27,98, o que resultou em R$ 3.863.926,08 por ano. Logo, chegou-se ao valor de R$ 3.616,52 por hectare/ano para a recuperação ou preservação das APPs da microbacia do Ribeirão São Bartolomeu. O valor estimado por ano para DATv foi de R$ 11.671.249,50, confirmando que a introdução deste componente aumenta consideravelmente o valor monetário do bem ambiental. Os valores encontrados podem servir de subsídios para o estabelecimento de políticas ambientais que consolidem a efetivação das APPs nas propriedades rurais.

Os portos são objeto recente de atenção da política ambiental brasileira. Por seu papel indutor de transformações territoriais em ampla escala, as atividades portuárias têm dado origem a inúmeros conflitos ambientais. As dificuldades das decisões de licenciamento ambiental refletem a incorporação tardia da gestão ambiental pelo setor e limitações das agências de meio ambiente, com destaque para a desarticulação entre planejamento e controles ambientais. A agenda ambiental portuária surge como iniciativa voltada a promover planos de gestão pactuados entre os atores locais.

Orientador: Archimedes Peres Filho Dissertação (mestrado) - Universidade Estadual de Campinas, Instituto de Geociencias Resumo: A bacia hidrográfica é um sistema ambiental complexo, resultante das inter-relações entre os subsistemas fisico-natural (natureza) e socioeconômico (sociedade). A compatibilidade entre as dinâmicas destes subsistemas - de modo a conciliar qualidade de vida e respeito aos limites e potencialidades do meio fisico - é a meta de um processo sustentável de desenvolvimento urbano. Grandes centros urbanos, como Campinas (SP), impõem ao paradigma da sustentabilidade seu maior desafio, já que se caracterizam por uma urbanização marcada por exclusão social e degradação ambiental. O planejamento e implantação de políticas visando a reversão deste quadro têm como importante instrumento de auxílio à tomada de decisões os indicadores de qualidade ambiental. Se apoiados em conceitos derivados do paradigma da complexidade, tais indicadores permitem a sistematização de informações sobre a dinâmica do sistema ambiental avaliado, facilitando a modelagem e o entendimento de sua organização espacial. Assim, tendo como embasamento teórico os paradigmas da complexidade e sustentabilidade e como procedimento metodológico a utilização de indicadores, o objetivo desta pesquisa foi avaliar a qualidade ambiental da bacia hidrográfica do córrego do Piçarrão (Campinas-SP). Com base principalmente em critérios geomorfológicos, foram identificadas 9 unidades ambientais presentes na bacia e, para cada uma, avaliada sua qualidade ambiental por meio da aplicação de indicadores. Foram utilizados 11 indicadores, divididos nas categorias de: a) pressão: densidade demográfica, domicílios improvisados/em favelas, coleta de lixo e esgoto; b) estado: declividade, densidade de drenagem, impermeabilização/exposição do solo e renda dos chefes de família; e c) resposta: diretrizes do Plano Diretor ligadas à qualidade ambiental, participação popular no Orçamento Participativo e prioridades relativas à qualidade ambiental definidas no Orçamento Participativo. Convertendo-se os indicadores para uma escala única de valores, foram obtidos, para cada unidade, Índices parciais (relativos a cada categoria) e final de qualidade ambiental. A avaliação comparativa das unidades ambientais evidenciou situações bastante heterogêneas, diversidade esta decorrente das particularidades de cada unidade em relação às características e processos dos subsistemas fisico-natural e socioeconômico e à dinâmica de inter-relações estabelecida entre eles na organização do sistema ambiental. Em comum, as unidades compartilham o fato de que - em diferentes graus e por motivos diferenciados, mas complementares - estão todas distantes de um desenvolvimento urbano sustentável. Assim, a avaliação da qualidade ambiental da bacia do Piçarrão revela as conseqüências de um modo de urbanização regido por interesses econômicos privados em detrimento ao bem-estar da coletividade, processo que gera e reforça desigualdade e exclusão sociais (refletindo-se em segregação socioespacial e vulnerabilidades diferenciadas aos riscos naturais) e degrada o meio fisiconatural. Como faces opostas e complementares desta forma de urbanização, verifica-se na bacia do Piçarrão, de um lado, a saturação da capacidade de sustentação do subsistema fisico-natural nas áreas em que este favorece a ocupação urbana - situação provocada principalmente pela impermeabilização elevada do solo e alta concentração populacional; do outro lado, constata-se que as áreas de maior fragilidade natural tendem a ser ocupadas pela população socialmente excluída e mais vulnerável aos riscos ambientais, alimentando uma dinâmica em que baixa qualidade de vida e baixa qualidade ambiental se reforçam mutuamente Abstract: River basins are complex environmental systems resulting of relations between physical-natural (nature) and socioeconomic (society) subsystems. Compatibility of these subsystems dynamics - represented by conciliation between quality of life and respect to nature's limits and potentials - is the goal of a urban sustainable development. Big urban centers, like Campinas (São Paulo State, Southeastern Brazil), represent the greatest challenge to sustainability paradigm, since their urbanization are characterized by social exclusion and environmental degradation. Politics that aim to revert this situation may rely on environmental quality indicators as a important decision-making tool. If these indicators are supported by concepts derived from complexity paradigm, they permit systematization of information about the environmental system under study and facilitate modeling and comprehension of its spatial organization. Based on complexity and sustainability paradigms and using indicators as methodological procedure, this work evaluated environmental quality of Piçarrão river basin (Campinas - Brazil). Geomorphological characteristics were used to define nine environmental units and their environmental qualities were assessed through application of eleven indicators, divided into three categories (pressure, state and response). Comparative evaluation between environmental units showed very heterogeneous situarions, but all of them share the fact that - at different levels and because distinct (although complementary) reasons - they are far of an urban sustainable development. Thus, environmental quality assessment of Piçarrão river basin reveals the consequences of an urbanization ruled by private economic interests in detriment of collective welfare. This process causes degradation of physical-natural subsystem, as well generates and reinforces social inequality and exclusion (reflecting in socio-spatial segregation and unequal vulnerabilities to natural risks). As opposites but complementary faces of this urbanization, in Piçarrão river basin was verified, on the one hand, the saturation of carrying capacity of physical-naturaI subsystem in areas where it favors urban occupation (situation mainly caused by excessive impermeabilization of soil and high concentration of population). On the other hand, areas with elevated natural fragility tend to be occupied by population that are socially excluded and more vulnerable to environmental risks, feeding a dynamics where low quality of life and low environmental quality are mutually reinforced. Physical Geography, namely Climatology, can give an useful contribution to understand the complicate network of relationships among multiple variables responsible for the longlist of environmental impacts founding the urban ecosystem. We support our argument on an example of Oporto, where it is obvious and carne out easily, the close links between climate and life quality standards. We show some examples of how inoperative will be an environmental policy if it tries to solve, for instance, the air and soil quality without knowing in detail the regional and local behavior of temperature, precipitation, pressure, wind, etc
