The article focuses on the ramifications of recent court battles on Australian bank lending. Recent developments in Australia have signaled the demise of the practice of negative pledge lending. Negative pledge lending developed in Australia during 1980s. It involved abandoning bankers' traditional and conservative insistence upon first mortgage security over bricks and mortar or other tangible assets. Borrowers benefited from negative pledge lending in several ways. First, the assets of the borrower remained unencumbered. Secondly, traditional mortgages involved publicity. Whereas, negative pledges attracted no publicity, no registration requirements and no stamp duty. Thirdly, the fact that all assets were available to all creditors made it easier for borrowers to introduce new lenders. Finally, many of the larger and more influential borrowers, with whom many banks were anxious to do business, found negative pledge borrowing easier. In contrast, negative pledge lending offered little to the lenders, although just how little it offered is only being discovered. It does not confer upon the lenders any proprietary or other interest in the assets of the borrower.
