The use of e-commerce in trade has had a big impact on Indonesian society, especially in terms of very important legal issues. Legal protection in e-commerce is crucial to protect consumers who make buying and selling transactions via the internet. This development is driven by high demand and acceptance from the public, as evidenced by the emergence of various online stores such as Kaskus, Tokopedia, Bukalapak, Shopee, and Lazada. Rapid advances in technology have changed the method of buying and selling from physical stores to online transactions via the internet. E-commerce, as an information technology innovation, allows consumers to make transactions with just the touch of a finger without having to leave the house. However, the variety of e-commerce platforms available increases the potential for legal issues in online transactions. This research aims to understand how to legally protect consumers and help them if losses occur in e-commerce transactions. The purpose of this study is to discusses the legal protection for credit card issuing banks in cases of customer default. In practice, customer defaults frequently occur, causing financial losses for issuing banks. This research aims to identify the legal measures that banks can take to protect their interests. The research methodology used is normative juridical with a descriptive analytical approach. The results indicate that banks have several legal recourses, such as resolving disputes through litigation and non-litigation avenues, and implementing protective clauses in credit card agreements. Additionally, existing legislation provides a strong legal foundation for banks to assert their rights. The article recommends that banks be more proactive in drafting clear and detailed agreements, as well as strengthening monitoring and collection mechanisms to minimize the risk of default. The Board of Directors is obliged to take responsibility for its actions on the employment contract agreement of any responsibility born of any transaction or employment contract activity carried out by it in accordance with the duties and responsibilities given by the board of commissioners to it as a director of the company, with the consideration that the activity has been carried out with due regard to prudential standards and good faith from the duties and functions as a director. The research method used is normative juridical research using primary, secondary, and tertiary legal materials and research places, data collection techniques in this research are literature studies and document studies and interviews, data analysis is carried out by collecting, classifying, and analysing based on the results of literature study research and studies in several companies, the results of the study show that the legal protection of the Board of Directors on agreements with third parties that harm the company so that if something undesirable happens, the sanctions for violations of the Board of Directors in their position as budget users will face criminal, civil and administrative sanctions. So that directors who get authority based on applicable laws and regulations in carrying out a work contract activity either obtained through delegation of authority, then have fulfilled the criteria in each agreement. Informed Consent is a prerequisite before a medical procedure can be considered legally valid and provide legal protection. Additional medical procedures can raise ethical, medical, and legal issues. There is no specific legislation focusing on legal protection for doctors regarding these additional medical procedures, but general principles of Indonesian law provide room for doctors to defend themselves if they have served patients professionally in accordance with professional standards and professional ethics. The research aims to analyze the procedures for obtaining consent for additional medical procedures and the legal protection for doctors providing these services to patients. The research method is conducted using a normative juridical approach with conceptual and case approach. The research results indicate that the purpose of obtaining consent for medical procedures is to protect patients from medical procedures performed without their knowledge and to provide legal protection for doctors from unforeseen and negative consequences. In the case of additional medical procedures, there must be renewed consent, and the procedure for obtaining consent depends on the availability of family members, either during or after the procedure. Doctors must comply with all medical standards and maintain complete medical records. In conclusion, the procedure for obtaining consent for additional medical procedures should be conducted during the procedure if family members are present or after the procedure if family members are absent, and legal protection for doctors in additional medical procedures is ensured through renewed written consent, maintaining complete medical records, and adhering to professional standards. In entering into a sale and purchase agreement for land rights that are still in the process of decertifying, the parties use a binding sale and purchase agreement or PPJB before the Deed of Sale and Purchase is made. This PPJB is present in notarial practice because it is not regulated in detail in Indonesia. Apart from that, the use of PPJB in land buying and selling practices can have its own implications for the parties. The purpose of this research is to find out and analyze legal protection for the parties in a land sale and purchase agreement where the land certificate is in the process of being resolved for the parties. The Land Sale and Purchase Agreement (PPJB) contains the rights and obligations of the parties who made it, so that if the matters agreed upon in the Sale and Purchase Agreement (PPJB) deed are violated or not fulfilled by the parties who made it, then this can be said to have been default occurs. Formulation of the problem raised in this research. What is the legal protection for the parties in a land sale and purchase agreement whose land certificate is in the process of being resolved? The research method used is an empirical research method, namely research that focuses on the behavior of the legal community. The approach method is carried out by studying documentation from literature materials as well as interviews with informants and requires primary data as the main data in addition to secondary data and tertiary data. The results of the research and discussion show that with the use of binding sale and purchase agreements for land which is still in the process of splitting the certificate, there is still a lack of legal protection which specifically regulates legal protection for the parties in binding agreements selling and buying land whose land certificates are in the process of being split, which results in a lack of legal certainty and creates a lack of legal protection, especially for buyers. From the results of this study, the author suggests that the Notary, in making a binding sale and purchase agreement, must be able to formulate in the contents of the Sale and Purchase Agreement matters that can protect the parties. The development of e-commerce transactions also provides opportunities and challenges for consumers. The opportunity for consumers is that they can easily and quickly get the goods or services they need. However, the challenge for consumers is the risk of fraud or violation of consumer rights in e-commerce transactions. The aim of this research is to determine legal protection regulations and their implementation for consumers in e-commerce transactions in Indonesia. This research uses legal research methods with a normative juridical approach. The data collection technique in this research is literature study. The data that has been collected is then analyzed qualitatively by understanding and interpreting the data in depth. The research results show that aspects of legal protection for consumers in buying and selling transactions via electronic media are regulated in several laws, namely Law Number 8 of 1999 concerning Consumer Protection, Law Number 7 of 2014 concerning Trade, and Law Number 19 of 2016 concerning Changes. Implementation of this Law is carried out through several steps, including the establishment of special regulations detailing consumer rights and obligations in electronic transactions. Apart from that, implementation also involves active law enforcement to deal with violations of consumer protection provisions as well as efforts to increase consumer awareness through various education and information programs. This research was carried out to determine and analyze legal protection for buyers in good faith in resolving land rights disputes. To achieve the research objectives, a document study has been carried out on the Decision of the Makassar District Court Number: 318/Pdt.G/BTH/2014, with three approaches, namely the conceptual approach, legislation and legal objectives. The research results show that in his legal considerations the judge stated that if the land sale and purchase transaction does not fulfill the "halal cause" element in accordance with the provisions of Article 1320 paragraph (4) of the Civil Code, then the buyer cannot be categorized as a buyer in good faith and therefore does not receive legal protection. The judge's consideration was seen as wrong because it did not take into account the element of the buyer's ignorance of the existence of hidden defects in the object of sale and purchase, that the object of sale and purchase was in the status of "dispute and court confiscation". Investment products in the financial services industry are currently very diverse, including deposits, shares, mutual funds and debt securities. However, Collective Investment Contract (KIK) Real Estate Investment Fund (DIRE) and Asset Backed Securities (EBA) products are underutilized by investors and corporations. In fact, this product has high yield potential amidst intensive national infrastructure development. REIT is a collective investment product that collects funds to invest in real estate assets. REITs have a minimum investment requirement of 80% for the property sector. Property buyers are at risk in the case of developer bankruptcy, as they are placed as concurrent creditors, which is detrimental to them. The purpose of this research is to examine how legal protection for female workers affected by termination of employment is implemented and to identify the challenges and constraints in providing legal protection for female workers facing Termination of Employment. The type of research conducted by the author is juridical-empirical research with a qualitative approach and a descriptive method. The research findings indicate that the rights of female workers are guaranteed in the constitution, laws, and implementing regulations, including several international agreements. Furthermore, these rights are also protected by the CEDAW Convention. Although these rights are detailed in legislation, not all female workers can fully utilize them. Constraints such as patriarchal culture, job marginalization, stereotypes, and a lack of socialization contribute to hindering the fulfillment of these rights. The era of the industrial revolution 4.0 has an impact on the transformation of business processes that encourage innovation and efficiency. The significant growth of internet users in the digital market in various fields, especially in the field of trade, has made it easier for consumers to carry out buying and selling activities without having to leave the house simply through e-commerce. Along with the rapid growth of e-commerce, it is directly proportional to the emergence of problems in the aspect of protecting citizens' personal data. The Tokopedia data leak case that occurred in 2020 is one of them. The issues discussed are regarding provisions regarding personal data protection in Indonesia, legal protection for leakage of consumer personal data on Tokopedia, and Tokopedia's responsibility for leakage of consumer personal data in electronic commerce. This thesis research method uses normative juridical legal research methods, namely referring to legal norms. This research is descriptive analytical, which reveals the laws and regulations related to legal theories that are the object of research. The data sources used in this study are primary data and secondary data. The method used in collecting data is to use document studies or library research, namely by studying laws and regulations, books, internet sites, mass media, and dictionaries related to the title of this thesis. As well as using field research, namely by asking the speakers related to the title of this thesis. Based on the results of the research obtained, it shows that the regulation regarding personal data in Indonesia has not been able to accommodate properly because it is still partial and sectoral. Tokopedia's legal protection against leakage of consumers' personal data is good through notification via email to each consumer that there is a data leak in the Tokopedia database and Tokopedia requires users to change passwords regularly. Tokopedia's responsibility for the leakage of consumers' personal data can be seen from Tokopedia's readiness and compliance in facing a lawsuit with number 235/Pdt.G/2020/PN Jkt.Pst. filed by the Indonesian Consumer Community. Domestic Neglect is one of type domestic violence that is experienced by many wives and children committed by their husband. This domestic rugulated in law Number 23 of 2004 on Domestic Violence. Victims of domestic neglect are entitled tp proctection from various parties, one of which is the police. This paper discusses how the implementation of protection provided by the Gorontalo Regional Police, especially the Women and Childern Service Unit (PPA) to victims of domestic neglect by their husband. This research uses empirical legal research methods carried put by colleting data through observation and interviews. The result of this study indicate that legal protection carried out by the Gorontalo Police Women’s and Childern’s Services Unit (PPA) has not been implemented optimally, because there are still victims’ rights that have not been implemented by the police. Trisomy 13 is a serious genetic anomaly in the fetus that is one of the causes of abortion as a result of the chromosomal aneuploidy. Trisomy 13 affects roughly 1 in 10,000 to 20,000 live births, and more than 95% of pregnancies end in prenatal death. Due to the higher prevalence of preeclampsia and the danger of maternal death associated with early birth, abnormalities in these infants also have an impact on the mother's health. There is a medical emergency condition to save the mother's life in trisomy 13 pregnancy. Termination of pregnancy avoids the adverse effects that will be experienced by babies with severe congenital abnormalities. According to Law No. 36 of 2009 concerning Health, women who eligble for abortions if there are medical reasons to do so. Pregnancies that endanger the fetus' life and health, including those with severe genetic diseases that cannot be treated so that they have a negative impact on the baby and mother's life are medically indicated for medical provocatus abortions. The problems in this paper are 1) What are the ethical problems found in pregnancies with a fetus diagnosed with a genetic disorder due to trisomy 13? 2) What is the procedure for implementing medical abortion provocation that fulfills ethical aspects and complies with applicable regulations. To answer these problems, a research using normative legal research, accompanied by reports of cases of abortion. This normative legal research focuses on ethical and legal aspects of the implementation of provocative medical abortion following statutory regulations. This normative legal research starts with articles and case reports of fetal pregnancies with genetic disorders from the Gatot Soebroto Army Hospital. The results of the study show that consent to termination of pregnancy with medical indications by the patient and approved by the husband/family. Termination of pregnancy in a fetus with a severe genetic disorder Trisomy 13 is a legal abortion if it is carried out according to medical indications and steps regulated in Health Law No. 36 of 2009 and Government Regulation No. 61 of 2014 concerning Reproductive Health. Comparison of Laws in Indonesia and the Netherlands in handling cases of child abduction or (kidnapping of a child by their own biological parents) even though they both adhere to the civil law system, Indonesia has not been a participant in the 1980 Hague Convention, since the end of 2014 until now, Indonesia's plan to become a participant in this convention has been discussed. Currently, an Academic Paper is being prepared for the Draft Law on Indonesia's Accession to the 1980 Hague Convention by the Directorate General of General Legal Administration at the Ministry of Law and Human Rights. Indonesia's participation was carried out through accession to the 1980 Hague Convention. Euthanasia is an act of intentionally not doing something aimed at prolonging someone's life or intentionally doing something to shorten or also end the life of a patient which is carried out to hasten his death, while enabling a good death without unnecessary suffering. Thus, in practice, in a terminal condition, a doctor may or may not perform an act that may result in the death of a patient in accordance with the written request of the patient/family. This dilemmatic condition requires legal certainty in order to uphold justice and humanity as well as legal protection. The problems are 1) How is passive euthanasia applied for terminal patients? 2) How is legal certainty in the application of euthanasia in Indonesia? 3) How is the implementation of euthanasia that meets the community's sense of justice? To answer these problems, a research using normative juridical methods is needed through primary data collection in the form of empirical data from interviews and filling out questionnaires about knowledge and level of agreement on euthanasia. Secondary data in the form of research on primary, secondary and tertiary legal materials. 8The results of the study show that the implementation of regulations in the Act and Ministerial Regulations that lead to the implementation of euthanasia has so far been applied, especially to terminal patients. However, the legal certainty of the act has not been clearly described because there are rules that are not in line. Euthanasia cannot be equated with ordinary homicide. Sanctions for temporary suspension (suspense) of trading against the company PT. Garuda Indonesia which receives sanctions from the Indonesia Stock Exchange (IDX) if it is related to the regulation of stock suspense in IDX Regulation Number 1-H concerning sanctions (Appendix to the Decree of the Director of PT Bursa Efek Jakarta Number: Kep-307 / BEJ / 07-2004. The regulation regarding incomplete stock suspense sanctions in IDX regulation Number 1-H regarding sanctions has the potential to cause losses to independent shareholder investors because it is not equipped with violation criteria that can be subject to stock suspense sanctions. Based on this background, there is a formulation of the problem as follows: How to regulate stock trading suspense sanctions for companies subject to suspense sanctions; How is the legal protection for shareholders who are subject to stock trading suspense sanctions by the Indonesia Stock Exchange. This research uses normative juridical research methods, with a statutory approach and a conceptual approach, using primary, secondary and tertiary legal materials which are analyzed using descriptive techniques and interprestaation techniques. The results of this study show that legal protection for investors affected by stock suspense consists of preventive legal protection and repressive legal protection. Preventive legal protection is preventive, namely by implementing the principle of openness (Disclosure Principle). Meanwhile, repressive legal protection is to provide recovery in the form of compensation where independent shareholders can file a lawsuit if the company's directors are deemed negligent and cause losses to the company. Fraud cases in electronic transactions are one of the crimes commonly committed on social media or e-commerce. Backround: The Religious Courts are one of the judicial powers as an effective means to realize access and control over material and non-material rights that are equal and gender-just. Purpose: This study aims to determine the legal considerations in the Decisions of the Pulang Pisau Religious Court Number 82/Pdt.G/2019/PA.Pps and Number 19/Pdt.G/2020/PA.Pps with justice and gender. Method: This research is a descriptive and deductive research. The deductive method is used to discuss a general problem leading to a specific discussion. The data analysis technique used in this study is a qualitative descriptive method, which is an analysis used to describe in words or sentences separated by category to get conclusions. Results: The results of this study conclude that Legal Protection Against Women in the Decisions of the Pulang Pisau Religious Court Number 82/Pdt.G/2019/PA.Pps and Number 19/Pdt.G/2020/PA.Pps From Juridical Review Aspects in Relation to Justice and Gender Equality. Conclusion: The mediation process is not yet gender friendly, the two guidelines for adjudicating women's cases in conflict with the law have not been implemented by the panel of judges, the three judges' Ijtihad have not taken sides with justice and gender equality. Legal protection is always related to government power and economic power, concerning government power, the legal protection for the people (those who are governed) against the government (those who govern). About the people, in Article 1, paragraph 3 of Law Number 13 of 2003 concerning employment, a worker or labourer is any person who works and receives wages in other forms. Workers are workers who work for employers and receive wages. The work agreement is divided into two: a specified time work agreement and an unspecified time work agreement. A contract worker works based on a work agreement for a certain time (PKWT), namely a work agreement between employers and workers to enter into a working relationship for a certain time or a certain job. Suppose in the employment agreement, the employer makes Termination of Employment (PHK), namely terminating the employment relationship because of a certain matter which results in the end of the rights and obligations of the worker. In that case, carrying out legal protection for the worker/labourer is very important. The author here will discuss issues regarding protecting the rights of contract workers who are laid off from companies and how legal remedies can be taken by contract workers who are laid off before the contract period ends. The purpose of the author, especially in the field of labour, is to prevent arbitrary termination of employment and to analyze the rights of contract workers who have been subject to Termination of Employment (PHK) before the contract period ends. The research method used is a problem approach through a statute approach and a conceptual approach. The results of the writing discussed by the author are that the party that terminates the employment relationship is required to pay compensation to the other party in the amount of the worker's salary until the expiration of the work agreement period. Trafficking in persons is an act that is inhumane and is a serious problem that must be resolved immediately. Indonesia is no longer a transit country but has also become a destination country for shipments and a sending country for victims of trafficking in persons. The mode that can occur in cases of trafficking in persons is through the Indonesian Migrant Workers mode. A person who is a victim of trafficking in persons is usually lured into working abroad with a large income. Trafficking in persons is a form of transnational crime, where there is usually involvement of people abroad and activities that occur across national borders. This research is a qualitative research with the research locus in Kupang, East Nusa Tenggara and also in Jakarta.
