We examine how an executive's consultations with interest groups during the formative stage of the policy process affect its bargaining success during the decision-making stage after it has proposed new policies to legislative actors. Our theory sets out how consultations with interest groups strengthen the executive by bolstering its formal and informal agenda-setting power. The empirical testing ground for our theory is the European Union ( EU), and in particular the consultations held by the European Commission. The analysis assesses the effects of these consultations on the congruence between the Commission's legislative proposals on controversial issues and EU laws. Our analysis incorporates detailed information on the type and scope of each consultation. In line with our theory, we find that the Commission had more success during the decision-making stage after conducting open consultations with large numbers of interest groups during the policy formation stage. The object of policy research is the understanding of the interaction among the machinery of the state, political actors, and the public. To facilitate this understanding, a number of complementary theories have developed in the course of more than two decades. This article reviews recent scholarship on the established theories of the policy process, mostly published in 2011 and 2012. Additionally, scholarship extending these theories is identified and new theories of policy process are discussed. This review finds that the established theories have generated substantive scholarship during the period under review and have also been the springboard for much of the recent thinking in policy research. Context Reducing HIV incidence in the United States and improving health outcomes for people living with HIV hinge on improving access to highly effective treatment and overcoming barriers to continuous treatment. Using laboratory tests routinely reported for HIV surveillance to monitor individuals' receipt of HIV care and contacting them to facilitate optimal care could help achieve these objectives. Historically, surveillance-based public health intervention with individuals for HIV control has been controversial because of concerns that risks to privacy and autonomy could outweigh benefits. But with the availability of lifesaving, transmission-interrupting treatment for HIV infection, some health departments have begun surveillance-based outreach to facilitate HIV medical care. Methods Guided by ethics frameworks, we explored the ethical arguments for changing the uses of HIV surveillance data. To identify ethical, procedural, and strategic considerations, we reviewed the activities of health departments that are using HIV surveillance data to contact persons identified as needing assistance with initiating or returning to care. Findings Although privacy concerns surrounding the uses of HIV surveillance data still exist, there are ethical concerns associated with not using HIV surveillance to maximize the benefits from HIV medical care and treatment. Early efforts to use surveillance data to facilitate optimal HIV medical care illustrate how the ethical burdens may vary depending on the local context and the specifics of implementation. Health departments laid the foundation for these activities by engaging stakeholders to gain their trust in sharing sensitive information; establishing or strengthening legal, policy and governance infrastructure; and developing communication and follow-up protocols that protect privacy. Conclusions We describe a shift toward using HIV surveillance to facilitate optimal HIV care. Health departments should review the considerations outlined before implementing new uses of HIV surveillance data, and they should commit to an ongoing review of activities with the objective of balancing beneficence, respect for persons, and justice. Context Evidence briefs have emerged as a promising approach to synthesizing the best available research evidence for health system policymakers and stakeholders. An evidence brief may draw on systematic reviews and many other types of policy-relevant information, including local data and studies, to describe a problem, options for addressing it, and key implementation considerations. We conducted a systematic review to examine the ways in which context- and issue-related factors influence the perceived usefulness of evidence briefs among their intended users. Methods We used a critical interpretive synthesis approach to review both empirical and nonempirical literature and to develop a model that explains how context and issues influence policymakers' and stakeholders' views of the utility of evidence briefs prepared for priority policy issues. We used a 'compass' question to create a detailed search strategy and conducted electronic searches in CINAHL, EMBASE, HealthSTAR, IPSA, MEDLINE, OAIster (gray literature), ProQuest A&I Theses, ProQuest (Sociological Abstracts, Applied Social Sciences Index and Abstracts, Worldwide Political Science Abstracts, International Bibliography of Social Sciences, PAIS, Political Science), PsychInfo, Web of Science, and WilsonWeb (Social Science Abstracts). Finally, we used a grounded and interpretive analytic approach to synthesize the results. Findings Of the 4,461 papers retrieved, 3,908 were excluded and 553 were assessed for 'relevance,' with 137 included in the initial sample of papers to be analyzed and an additional 23 purposively sampled to fill conceptual gaps. Several themes emerged: (1) many established types of 'evidence' are viewed as useful content in an evidence brief, along with several promising formatting features; (2) contextual factors, particularly the institutions, interests, and values of a given context, can influence views of evidence briefs; (3) whether an issue is polarizing and whether it is salient (or not) and familiar (or not) to actors in the policy arena can influence views of evidence briefs prepared for that issue; (4) influential factors can emerge in several ways (as context driven, issue driven, or a result of issue-context resonance); (5) these factors work through two primary pathways, affecting either the users or the producers of briefs; and (6) these factors influence views of evidence briefs through a variety of mechanisms. Conclusions Those persons funding and preparing evidence briefs need to consider a variety of context- and issue-related factors when deciding how to make them most useful in policymaking. This article introduces to policy studies the concept of valence, which we define as the emotional quality of an idea that makes it more or less attractive. We argue that valence explains why some ideas are more successful than others, sometimes gaining paradigmatic status. A policy idea is attractive when its valence matches the mood of a target population. Skilled policy entrepreneurs use ideas with high valence to frame policy issues and generate support for their policy proposals. The usefulness of the concept of valence is illustrated with the case of sustainability, an idea that has expanded from the realm of environmental policy to dominate discussions in such diverse policy areas as pension reform, public finance, labor markets, and energy security. As the valence of sustainability has increased, policy entrepreneurs have used the idea to reframe problems in these various policy areas and promote reforms. [ABSTRACT FROM AUTHOR]

The article discusses the motivations for the development of the Keynesian welfare state and for the era of neoliberalism that began in the 1980s. It also discusses the preconditions for policy change, government social spending, and class compromise during the post-crisis transition period. Governments make policy decisions in the same areas in quite different institutions. Some assign policymaking responsibility to institutions designed to be insulated from myopic partisan and electoral pressures and others do not. In this study, we claim that differences in political context and institutional design constrain the policy choices governments make. Testable propositions based on an analysis of varying electoral incentives and time horizons created by these different contexts are empirically tested using panel data on official general fund revenue forecasts in the American states, 1987 to 2008. The empirical evidence reveals that executive branch agencies and independent commissions produce more conservative forecasts than legislatures with one important exception. Executive branch revenue forecasts in states with gubernatorial term limits are indistinguishable from legislative branch forecasts. Further, we find that legislative branch forecasts are more conservative in the presence of divided partisan legislatures than unified party government. In turn, this implies that entrusting policymaking authority to either the executive branch or an independent commission may only be consequential when the political system itself fails to check legislative excesses or executive myopia. © 2012 by the Association for Public Policy Analysis and Management. Background North America's first supervised injection facility- Insite-opened in Vancouver in 2003 under a special federal legal exemption. Insite has faced significant political and legal opposition, which culminated in a recent Supreme Court of Canada ruling that ordered the federal Minister of Health to extend the facility's exemption and cited evidence that the facility is life-preserving and does not increase public disorder. Officials in several other cities have initiated or accelerated preparations for new facilities due to speculation that the ruling provides sufficient legal basis to expand supervised injection in Canada. However, a comprehensive assessment of the barriers and facilitators to supervised injection facility scale-up is lacking. Methods This policy case study reviews a corpus of jurisprudence, legislation, scientific research and media texts to: describe the role of evidence in legal and political decision-making around Insite; analyze the implications of the Insite decision for new facilities; and discuss alternative avenues for supervised injection facility expansion. Results The Insite decision does not simplify the path towards new supervised injection facilities, but nor does it does pose an insurmountable hurdle. Whether new facilities will be established depends largely upon how the Minister of Health interprets the ruling, the proponents' ability to demonstrate need and support from municipal and provincial governments and community members. Formally defining supervised injection as within nurses' scope of practice could further efforts to establish new facilities. Context Policymakers and practitioners continue to pursue initiatives designed to engage individuals in their health and health care despite discordant views and mixed evidence regarding the ability to cultivate greater individual engagement that improves Americans' health and well-being and helps manage health care costs. There is limited and mixed evidence regarding the value of different interventions. Methods Based on our involvement in evaluating various community-based consumer engagement initiatives and a targeted literature review of models of behavior change, we identified the need for a framework to classify the universe of consumer engagement initiatives toward advancing policymakers' and practitioners' knowledge of their value and fit in various contexts. We developed a framework that expanded our conceptualization of consumer engagement, building on elements of two common models, the individually focused transtheoretical model of behavior and the broader, multilevel social ecological model. Finally, we applied this framework to one community's existing consumer engagement program. Findings Consumer engagement in health and health care refers to the performance of specific behaviors ('engaged behaviors') and/or an individual's capacity and motivation to perform these behaviors ('activation'). These two dimensions are related but distinct and thus should be differentiated. The framework creates four classification schemas, by (1) targeted behavior types (self-management, health care encounter, shopping, and health behaviors) and by (2) individual, (3) group, and (4) community dimensions. Our example illustrates that the framework can systematically classify a variety of consumer engagement programs, and that this exercise and resulting characterization can provide a structured way to consider the program and how its components fit program goals both individually and collectively. Conclusions Applying the framework could help advance the field by making policymakers and practitioners aware of the wide range of approaches, providing a structured way to organize and characterize interventions retrospectively, and helping them consider how they can meet the program's goals both individually and collectively. This article examines the infrastructure policy sector's capacity to respond to climate change adaptation through an analysis of the Canadian case. It includes a three-level examination of capacity: at the macro level through a virtual policy network analysis; at the meso level through examination of the lead department's evolving mandate and resources; and at the micro level through analysis of survey data related to departmental workers policy tasks and attitudes. Four hypotheses across these three levels are set out and tested at the national and subnational levels. Together, the findings suggest that the policy capacity in the Canadian infrastructure sector will be unable to meet the demands placed upon the sector to respond to the increasing challenges of climate change adaptation. 'Best practice' in policymaking and institution-building for the deployment of grid-connected renewable energy (GCRE) can be found scattered throughout reports and policy papers of major international actors and in the discourse of policymakers and businesspeople. This article collects and systematizes a 'best practice' model and portrays it as a sector-specific description of a liberal market economy (LME). Also, the article provides a comparison of China's policies and institutions for GCRE with 'best practice,' finding that China's approach coincides with the latter only imperfectly. Divergences of the Chinese approach to GCRE as compared with the model can be explained, at least partially, in that 'best practice' pertains to LMEs, and given that China is arguably not an LME. Hence, the particularities of China's approach to GCRE should be understood not as obstacles to renewables but as examples of regulatory and institutional diversity. [ABSTRACT FROM AUTHOR]

In 2010, the Coalition government announced in its Programme for Government, that: 'We will extend anonymity in rape cases to defendants.' The question of anonymity for defendants accused of rape and other sexual offences, has been repeatedly raised in parliamentary debates over several decades, and has also received frequent attention in newspapers and, to a lesser extent, in academic and professional literature. The debate includes an array of factual claims and arguments that rest on weak empirical foundations. In November 2010, the Ministry of Justice published a report entitled: Providing Anonymity to those Accused of Rape: An Assessment of Evidence, which was intended to provide an evaluation of evidence that would inform the debate over defendant anonymity. This article critically examines this report and its discussion of key issues such as false rape allegations, and considers whether its conclusions can be relied upon by policy makers.
