The Chapter deals with the use of sanctioning powers in the context of EU data protection law and reflects on the thorny relationship between different typologies of sanctions (criminal and administrative) in the light of the new administrative sanctioning powers of the Data Protection Authorities. The analysis starts form short historical presentation of the EU (secondary) laws dealing with data protection and, then it looks at changes to EU primary law brought about by the Treaty of Lisbon with an explicit imperative to improve EU data protection. The core of the analysis discusses the system of remedies in the GDPR and some examples of recent sanctioning practices by the national DPAs. The analysis is followed by three more reflective sections about supervisory convergence without creating new EU institutions, the administrative enforcement fray and defence rights and the role of criminal law in EU data protection law. The chapter also offers some guidance observations about the operationalisation of the threefold system of enforcement set up by EU data protection law.

In light of the ongoing story on the regulatory steps towards electronic evidence and transnational production orders, civil rights organizations have expressed both alarm and astonishment on the regulatory initiatives in the Council of Europe regarding transnational production orders. Member states of the European Union (EU) engage actively in soft law entrepreneurship by allowing themselves to obtain directly from service providers subscriber and other communications content. This has not only been done domestically through national laws but likewise on a multilateral level as EU member states are now seen drawn towards the Council of Europe. Within said Council of Europe, member states are now enabled to stretch the extraterritorial powers exercised by their law enforcement authorities in obtaining electronic evidence through a controversial Guidance Note and soon, a Second Additional Protocol. Interestingly, throughout these developments, the EU remained passive but as of late, has come up with proposals for the European Production and Preservation Orders, among others. The mixture of alarm and astonishment among civil liberties representatives about the decision making procedures at the level of the Council of Europe can be best understood in a broader regulatory context of policy enterpreneurship, rent-seeking behaviour and, overall, rational choice institutionalism. Comparing the Council of Europe with the EU, the structure of the former makes it the more attractive venue for policy actors such as law enforcement authorities to maximize their benefits at the least amount of costs. Being competitors in policymaking vis-à-vis cooperation in criminal matters, the EU can however lose its sociopolitical ascendancy over time as an institutional venue to discuss cooperation matters. In light of this, one should not forget that two Europes coexist. These coexisting realities are now being used to the advantage of laundering policies, testing which forum would maximize benefits the most. These developments should caution us that there might be a systemic failure in ensuring safeguards in criminal investigations are always in place.

This contribution aims to better understand how and why International Criminal Law (ICL) is pluralistic and how this pluralism is at least partly the result of the contesting actions, interests and backgrounds of the various ICL users and the context in which they operate. The hypothesis is that the adoption of a users’ perspective helps to understand ICL pluralism. After a discussion of the various dimensions of pluralism in ICL, this chapter identifies the most important ICL users. Nevertheless, it will also be demonstrated, through the example of the case against the former Chadian dictator Hissène Habré, that pluralism can be overcome, as ICL is also often a collaborative ingenious effort of various users which are able to align their interests in the pursuit international criminal justice

The two European Courts (the European Court of Human Rights, ECtHR and, to a lesser degree, the European Union Court of Justice, EUCJ) have contributed greatly to the development of a legal framework for surveillance by either law enforcement agencies in the criminal law area or by secret services. Both courts put great emphasis on a system of control ex ante and post hoc by independent supervisory authorities. A complex and controversial issue remains whether the human rights to privacy, respect of communications, and to an effective remedy (enshrined in Article 8 and 13 of European Convention on Human Rights (ECHR)), requires judicial review as a necessary safeguard for secret surveillance or alternatively, at which conditions, parallel systems of non-judicial review can be accepted as adequate safeguards against illegitimate interference in citizens’ private life. The European Courts have not yet established a clear doctrine in determining suitable thresholds and parameters. In particular, the ECtHR has a flexible approach in interpreting article 8 and 13 ECHR, depending on several factors (“vital” interests at stake, political considerations, etc.). In general terms, the Court has shown a preference towards judiciary oversight, but in the European legal order there are several examples of alternative oversight systems assessed positively by the Court, such as the quasi-judiciary systems (where the independency of the supervisory body, its wide jurisdiction, its power to data access and its power to effective reactions are proved) or the system of oversight set by Data Protection Authorities in the EU member states. However, in recent judgements of the ECtHR and the EUCJ we see an increasing emphasis on declaring the necessity of a “good enough” judicial (ex ante or post hoc) control over surveillance, meaning not simply a judicial control, but a system of oversight (judicial, quasi-judicial, hybrid) which can provide an effective control over surveillance, supported by empirical checks in the national legal system at issue.

Gary Becker died on 3 May 2014. He was an economist, Noble prize winner and author. He was declared by Milton Friedman as the “the greatest social scientist who has lived and worked in the last half century”. His work focused on economics and sociology, and through the lenses of these disciplines he looked at many subjects, including crime and the criminal law. His crucial finding that crime is the sum of rational actors still has a lot to off er to criminologists and practitioners working in the area of criminal law. This editorial pays tribute to his analytical spirit by embracing it when assessing the EU legislation to combat human trafficking.

This article offers a critical examination of the court judgements in a recent Belgian case against Yahoo!. It examines the challenges related to the establishment of jurisdiction for Internet-based services and the role that procedures of mutual legal assistance should play. Belgian law obliges providers of “electronic communications services/electronic communications networks” to cooperate with Belgian law-enforcement authorities and to handle over communication and personal data. Although the terms are derived from the EU Electronic Communications Regulatory Framework, a much broader interpretation to them was finally given by the Belgian Supreme Court. Seemingly this implies that, from now on, a US-based company such as Yahoo! is, at least under Belgian law, under a legal obligation to directly comply with an order issued by Belgian law-enforcement authorities.

‘Een zwarte dag voor justitie’. Met enige dramatiek bekritiseerde een onderzoeksrechter het dataretentiearrest van het Grondwettelijk Hof van 13 juni. In de media kondigden enkele advocaten al meteen aan vrijspraken te vragen in lopende zaken waarin telecommunicatiedata werden gebruikt. Heeft het Grondwettelijk Hof binnenkort tal van vrijgesproken criminelen op zijn geweten?

Dit handboek is een van de weinige handboeken in het Nederlands waarin zowel het klassiek internationaal strafrecht, het recht van de internationale straftribunalen, het moderne uniestrafrecht en de internationale en Europese grondrechten in hun strafrechtelijke dimensies aan bod komen. Het boek is in een zeer toegankelijke taal geschreven, waardoor het niet enkel juristen maar ook historici, politieke wetenschappers en andere geïnteresseerden zal aanspreken. Het werk wordt ingeleid met een overzicht van de algemene beginselen en de historische ontwikkeling van het internationaal en Europees strafrecht, gevolgd door een analyse van de meest toonaangevende regionale en internationale instrumenten voor uitlevering, overlevering, kleine, primaire en politiële rechtshulp. Vervolgens wordt de impact van de grondrechten op het strafrecht behandeld, waarna wordt afgesloten met het recht van het Internationaal Strafhof en andere internationale straftribunalen.

The proposed data protection regulation2 includes mention of the use of criminal and administrative sanctions. Both were possible in EU data protection law but, after the reform, the use of administrative sanctions will become mandatory. With regard to criminal sanctions to address data protection wrongs, nothing changes: member states can choose to create them or not. Why is the new EU, with its enhanced post-Lisbon powers, so timid and '1995-ish' with regard to criminal law? How is it possible that, to reform a set of rules created by a directive, a regulation is chosen with the aim of harmonising just about everything in EU data protection law, but not the chapter on sanctions and enforcement? This contribution lists some explanatory factors and reflects on future regulatory choices in member states.

In Belgium, the drug trafficking offences and their different penalties are set out in the 1921 Law on Drug Trafficking ( ). The legal provisions already take into account aggravating circumstances and criteria such as ‘health age’, the individual’s age, etc.

Naar aanleiding de evolutie in de strafprocedure in Nederland en België schetsen de auteurs een conceptueel kader aan de hand van de begrippen adversair strafproces en inquisitoir strafproces. Ten opzichte van dit kader vindt vervolgens een analyse plaats van ontwikkelingen in het vooronderzoek, in het bijzonder wat betreft de Wet versterking positie rechter-commissaris, en bij de afhandeling van strafzaken.

Uitgebreide en diepgaandere selectie van de meest relevante wetgeving: Dit themawetboek bundelt de meest relevante wetgeving inzake wapens. Gestreefd werd naar een bredere en diepgaandere selectie die zich niet beperkt tot de basiswapenwetgeving.??Het themawetboek richt zich voornamelijk tot de personen die zich op professionele wijze in de juridische sector met wapens te maken hebben, met name advocaten, magistraten, ambtenaren en personen in de lokale besturen en de politie. Daarnaast is het themawetboek ook nuttig voor wapenbezitters, jagers en sportschutters, die in dit themawetboek zeker de wetgeving relevant voor hun activiteiten kunnen terugvinden. Het themawetboek bestaat uit twee luiken.?Het eerste luik bestaat uit een inleidende tekst met een overzicht van de wetgeving over het gebruik en het bezit van wapens in Vlaanderen. Deze inleiding behandelt op zeer summiere wijze de geschiedenis van de wapenwetgeving in België, de Wapenwet en de mogelijkheid tot het bezitten en dragen van wapens, deregelgeving inzake het vervoer en de in- en uitvoer van wapens en tot slot de regelgeving rond het sportschieten en de jacht. Het tweede luik bevat eigenlijke opsomming van de wetgeving. De opgenomen wetgeving is opgedeeld in acht thematische delen. Het eerste deel behandelt de algemene en overkoepelende wetgeving inzake wapens. Het tweede deel omvat de indeling van de wapens, munitie en wapenonderdelen. Het derde deel behandelt explosieven. Het vierde deel is geweid aan de reglementering van massavernietigingswapens. Het vijfde deel somt de wetgeving op die de bewapening van de openbare orde en diensten beheerst. Het zesde deel behandelt het vervoer en de in- en uitvoer van wapens in Vlaanderen. Tenslotte behandelen het zevende en achtste deel respectievelijk de jacht en sportschieten. Een verdere verantwoording van de selectie van de teksten is opgenomen op het einde van de inleidende tekst. De materie is bijgewerkt tot 10 juli 2013. De wetgeving werd op chronologische wijze opgenomen. ++++++ Handige bundeling van de wetgevende teksten inzake wapens:?Op het internationaal niveau neemt deze Codex Wapenwetgeving multilaterale verdragen en overeenkomsten op. Er werd gekozen voor het indelen van de internationale en Europese wetgeving in hun relevante categorieën in plaats van ze te bundelen in één categorie die enkel deze teksten zou omvatten. De reden hiertoe is de uitgebreide onderwerpen waarover deze internationale teksten handelen, waardoor deze categorie op zich onoverzichtelijk en incoherent dreigde te worden. In de selectie van interne regelgeving werden enkel de regelgeving opgenomen die relevant was voor Vlaanderen en het Brussels Hoofdstedelijk Gewest. Het eerste deel bevat de algemene wetgeving. Hieronder valt zowel de wapenwet en haar uitvoeringsbesluiten zelf als andere wetgeving die relevant is, zoals organieke wetten en besluiten voor de instellingen die aan bod komen in de wapenwetgeving, zoals de Adviesraad voor wapens en de Proefbank voor vuurwapens. Verder wordt er in het eerste deel algemene internationale en supranationale wetgeving opgenomen, waaronder het Verdrag van 10 oktober 1980 inzake het verbod of de beperking van het gebruik van bepaalde conventionele wapens die geacht kunnen worden buitensporig leed te veroorzaken of een niet-onderscheidende werking te hebben, het Verdrag van 15 november 2000 tegen transnationale georganiseerde misdaad en de Europese Vuurwapenrichtlijn van 18 juni 1991. Ook in het eerste deel opgenomen zijn de wetgevende teksten die misdrijven gepleegd met of ten aanzien van wapens opsommen. Ten slotte bevat het eerste deel van de Codex teksten die nergens anders op hun plaats zijn, zoals de wetgeving die de private beveiligingsdiensten beheerst, de Wet op de militaire opeisingen en de Wet betreffende de verzekering tegen de schade veroorzaakt door terrorisme. Het tweede deel bevat een opsomming van de bijkomstige regelgeving genomen om bepaalde wapens, munitie en wapenonderdelen in te delen in één van de categorieën die ingesteld worden door de wapenwet. Het gaat hier omtrent de historische, decoratieve en folkloristische wapens, gas- en luchtdrukwapens en alarmwapens, alsook om bepaalde types munitie en bepaalde hulpstukken, bijvoorbeeld laders met een abnormaal grote capaciteit. Het derde deel van de Codex behandelt explosieven. In deze categorie zit Richtlijn 93/15/EEG van de Raad van 5 april 1993 betreffende de harmonisatie van de bepalingen inzake het in de handel brengen van en de controle op explosieven voor civiel gebruik, de Wet van 28 mei 1956 betreffende ontplofbare en voor de deflagratie vatbare stoffen en mengsels en de daarmede geladen tuigen en diens uitvoeringsbesluiten.??Het vierde deel van deze selectie bevat de, voornamelijk internationale wetgeving inzake massavernietigingswapens. Hier gaat het dus zowel om biologische en chemische als nucleaire wapens. De nadruk ligt echter bij de nucleaire wapens. Het gaat dan zowel om het verbod op de verspreiding van kernwapens en kennis inzake kernwapens, alsook het verbod op nucleaire testen. Opgemerkt moet worden dat het Kernstopverdrag van 10 september 1996 niet opgenomen werd daar het nog niet in werking is getreden. Het vijfde deel van deze Codex behandelt de bewapening van de personeel van de openbare ordehandhaving als van andere openbare diensten. Hier werd zowel gekeken naar de politiediensten en het leger als naar andere diensten zoals de douane, de veiligheidsdiensten van de openbare vervoersmaatschappijen en de gemeenschapswacht. Ook werd er aandacht besteed aan de mogelijkheid van bewapening van personeel die opdrachten over de grenzen heen uitvoeren, bijvoorbeeld inzake douane of in het geval van een crisissituatie zoals gedefinieerd door het Besluit 2008/617/JBZ van 23 juni 2008 van de Raad ter verbetering van de samenwerking in crisissituaties tussen de speciale interventie-eenheden van de lidstaten van de Europese Unie. Het zesde deel verzamelt alle wetgeving die de regeling van het vervoer en de in- en uitvoer van wapens beheerst. Deze materie is voornamelijk regionaalgeregeld.??Ten slotte zijn er de laatste twee delen die, voor de jacht en het sportschieten respectievelijk, de bundeling vormen van de relevante wetgeving. Beide categorieën leggen nadruk op de regionale wetgeving die deze materie beheersen. Hier wordt er gekeken naar de vergunningsverplichtingen, de handelingen die gesteld mogen worden, de verzekeringen die verplicht aangenomen moeten worden om deze activiteit te kunnen uitvoeren. Voor de jacht zijn er echter nog een aantal andere teksten, federaal en internationaal, betreffende het behoud van het milieu en de verscheidenheid van diersoorten, die ook verbodsbepalingen opnemen.

In their recent European criminal policy documents, the Institutions have highlighted the relevance of subsidiarity for European criminal law. In this paper we demonstrate that such principle, in its current institutional understanding, cannot adequately address issues related to the distribution of criminalisation powers between the EU and the Member States. Article 5(3) TEU describes subsidiarity as an efficiency based-criterion aimed at tackling technical competence-exercise issues (instrumental subsidiarity). Such a restricted perspective is not desirable for the penal field. As a matter of fact, when shifting criminal issues up to the Brussels agenda, aspects related to democracy, legitimacy, internal coherence of the criminal law system, and risks of hyper-repressive developments must also be considered along with efficiency concerns. Moreover, such interpretation cuts off from the discussion all normative competence-attribution issues (substantive subsidiarity), which are raised by the most relevant criminal law provisions, such as Article 83(1) TFEU and Article 83(2) TFEU.

This contribution will focus on the facet of International Criminal Justice where the influence of global law is the most apparent, namely the hybrid or internationalized criminal tribunals. Since many of these tribunals have closed their doors or are in the advanced stage of the proceedings, the time is ripe for a preliminary evaluation. Furthermore, the future necessity and viability of hybrid tribunals will be assessed, both for crimes that fall within and without the jurisdictional regime established by the International Criminal Court (ICC).

De wetten van 14 april en 11 juli 2011 hebben de mogelijkheid van de afhandeling van een strafzaak door middel van een minnelijke schikking aanzienlijk verruimd. In deze bijdrage gaan de auteurs na wat deze uitbreiding precies inhoudt en wordt hier een kritische reflectie aan gewijd. Deze wetgeving noopt tot een reflectie rond de beoogde ontlasting van het gerechtelijk apparaat, de vermeende herstelrechtelijke inslag, de transparantie bij het onderhandelen en de vrijheid die een verdachte heeft om al dan niet een minnelijke schikking na te streven of te aanvaarden. De meest opmerkelijke evolutie waar de verruimde minnelijke schikking blijk van geeft, is de mogelijkheid van een consensuele oplossing na het instellen van de strafvordering. Aan dit laatste gegeven wordt dan ook de meeste aandacht besteed. Enige kritiek wordt geformuleerd op de concrete uitwerking van de nieuwe regeling en op de opties die de wetgever zelfs niet heeft overwogen.

There has been a progressive incorporation into Belgian law of the instruments to fight and protect against cyber criminality. The first stages, in the nineties, limited themselves mostly to regulating, in dispersed order, the protection of personal data (1992) by integrating in a progressive manner the specificities of computerized handling of data (reforms of 1998 and 2003). The March 21th 1991 Act on the reform of certain economic public enterprises determines the terms which a third person has to observe in order to intercept or monitor data that have been transferred by means of telecommunication, at a time when the means of communication are substantially still in the hands of public enterprises, while at present, as we have already seen, the Belgian judicial authorities have been obliged to open criminal proceedings against YAHOO! In order to have it cooperate in a judicial inquiry, whereas the company, though offering services in Belgium, argued it could not be forced to co-operate directly as the requested data were stocked in the United States. Facing such liberalisation and globalisation of telecommunication, the lawgiver has been coerced to design new tools by defining facts of abuse of domain names (2003), the services of the information society (E-commerce Act - 2003), computer programs (2004), electronic communications (2005 and the reforms of 2009 and 2010) or electronic payments (2005 and 2009).

Met de wetten van 1999 en 2004 betreffende de invoering van gemeentelijke administratieve sancties (kortweg GAS-wetgeving) hebben gemeenten nieuwe juridische instrumenten gekregen om overlastfenomenen krachtdadiger te kunnen aanpakken. Voortaan kunnen gemeenten voor gedragingen die een inbreuk uitmaken op de openbare orde (netheid, veiligheid en rust) of die 'openbare overlast' veroorzaken, een bestuurlijke sanctie tot 250 euro opleggen. In deze bijdrage wordt nagegaan hoe de 19 gemeenten van het Brussels Hoofdstedelijk Gewest dit lokaal 'overlastrecht' invullen. Vastgesteld wordt dat er veel verschillen zijn op het vlak van zowel de inhoud, de procedure en modaliteiten van de gemeentelijke administratieve sancties (bemiddeling, de vaststelling, bedragen), als van de keuze voor beboeting of bestraffing. Hoewel de facto een zekere uniformisering van het Brusselse politie- en veiligheidswezen heeft plaatsgevonden en het Gewest hier en daar bijstuurt, heeft het Brussels Gewest behoefte aan een grotere institutioneel verankerde regierol., The laws of 1999 and 2004 concerning the implementation of municipal administrative sanctions (in short GAS legislation) gave local authorities new legal instruments to act more vigourously against phenomena of nuisance. Local authorities can now impose an administrative fine of up to 250 euros for behaviour which is contrary to public order (cleanliness, safety and quiet enjoyment) or which causes "public nuisance". This publication purports to assess how the 19 municipalities of Brussels Capital Region formulate and apply this local "nuisance law". Many differences emerge in terms of the content, the procedure and the modalities of municipal administrative sanctions (mediation, taking the minutes, amounts) and in terms of the choice between fines or police punishments . Even though some de facto harmonisation has taken place among Brussels police and security matters and the Region intervenes to make adjustments where necessary, the Brussels Region needs more institutionally-based guidance.

Meer in het bijzonder willen we hier een in ons land nog controversiële, maar bijzonder actuele discussie over het registreren van etnische gegevens voor antidiscriminatiedoeleinden in de schijnwerpers plaatsen, maar dan toegespitst op de identiteitscontrole: namelijk het idee om naar het voorbeeld van het Verenigd Koninkrijk meetmechanismen te hanteren die het geheel van de identiteitscontroles en de ‘kleur’ van de gecontroleerde persoon (kwantitatief) in kaart brengen, zodat discriminerende, ‘gerichte’, stigmatiserende praktijken zichtbaar kunnen worden
