CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior A tese defende o Pluralismo Constitucional como teoria capaz de melhor descrever e explicar as interações entre a Constituição Federal de 1988 e a Convenção Americana sobre Direitos Humanos. As interações ocorrem através de processos dialógicos deliberativos, especialmente, entre os precedentes do Supremo Tribunal Federal e da Corte Interamericana de Direitos Humanos. A tese expõe a fragilidade teórica e o descompasso contextual das abordagens calcadas na dicotomia monismo/dualismo. O Pluralismo Constitucional, por sua vez, sugere a interação heterárquica entre ordenamentos constitucionais através de influências mútuas. A supralegalidade dos tratados internacionais de direitos humanos e a deferência às interpretações constitucionais regionais possibilitam à Constituição de 1988 e à Convenção Americana sobre Direitos Humanos, respectivamente, influenciar o conteúdo substancial dos direitos fundamentais e humanos por meio do diálogo deliberativo entre precedentes e tendo a construção do princípio pro homine por ideal interpretativo guia compartilhado por ambas. Não obstante seja considerada a teoria que justifica a leitura plural das normas constitucionais brasileiras, o Supremo Tribunal Federal, apesar de utilizar precedentes da Corte Interamericana de Direitos Humanos, com eles não dialoga. The thesis argues for the Constitutional Pluralism as a theory better suited to describe and explain the interactions between the 1988 Federal Constitution and the American Convention on Human Rights. Said interactions present themselves through the precedents of both the Supreme Court and the Inter-American Court of Human Rights. The thesis posits the theoretical fragility and the contextual mismatch of approaches based upon the monism/dualism dichotomy. Constitutional Pluralism, in turn, suggests the heterarchical interaction between constitutional orders through reciprocal influences. The supralegalty of international human rights treaties and the deference to regional constitutional interpretations enables the 1988 Constitution and the American Convention on Human Rights, respectively, to influence the substantive content of the fundamental and human rights through the deliberative dialogue between precedents and by having the construction of the pro homine principle as an ideal interpretive guide shared by both. Although Constitutional Pluralism is to be considered the theory that justifies the plural reading of the Brazilian constitutional provisions, the Supreme Court, despite the citations of the Inter-American Court of Human Rights precedents, does not dialogue with them.

CNPq - Conselho Nacional de Desenvolvimento Científico e Tecnológico CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior O trabalho analisa o efeito vinculante, visando compatibilizar o referido instituto dentro da prática do controle de constitucionalidade brasileiro, ressaltando a importância da interpretação da Constituição feita pelo STF e a proteção dos direitos fundamentais. No trabalho, os precedentes vinculantes são considerados princípios, que dispõem de força gravitacional justificada pelo princípio da igualdade na aplicação do direito, ao passo que a ação reclamatória é encarada como um importante instrumento para a interpretação dos precedentes vinculantes, capaz de manter as vias abertas para sua possível distinção ou revogação. Nesse sentido, a categoria que impõe a vinculação formal do precedente vinculante constitucional é a norma de decisão, que seria a proposição jurídica apta a sustentar a conclusão do tribunal sobre a (in) constitucionalidade do ato impugnado. Concluímos, de acordo com as atuais decisões do STF, que a recusa em atribuir efeitos vinculantes transcendentes mais amplos aponta para um reforço do controle difuso, permitindo que a interpretação principiológica do precedente e seu desenvolvimento ocorram no controle difuso. A teoria do direito escolhida como suporte das conclusões do trabalho foi a de Ronald Dworkin. The work provides some discussion regarding the binding effect, which aim to reconcile such institute within the practice of Brazilian judicial review, pointing out the importance of the constitutional interpretation made by the Supreme Court and the protection of fundamental rights. In said work, precedents are binding principles, which have gravitational force justified by the principle of equality in applying the law and the constitutional complaint is considered an important instrument for the interpretation of the binding precedent, capable of keeping the ways open for further distinguishing or reconsideration of prior decisions. Thus, the category that imposes the formal binding is the decision norm, which is a legal proposition able to sustain the ruling of the court on the (un) constitutionality of the act. We conclude that the refusal to give a broader transcendent binding effect indicates a strengthening of the diffuse control, allowing the interpretation and development of the precedents. Ronald Dworkin´s theory of law was chosen to support the conclusions of the study.

The Italian´s and Spanish´s systems of concentrated control of constitutionality have features that distance them from the pure kelsen´s model and, at the same time, allow us to identify them with the North American´s model of constitutionality control. The assignment of binding effect, in horizontal and vertical planes, to the constitutional decisions, even if it is not an element used to identify, so immediately, the constitutional jurisdiction of the European countries, is, undoubtedly, one of its characteristic elements, and gives rise, in this context, to the figure of the previous binding. So for these precedents may be adopted in regard to the principle of equality in law enforcement, it is essential that requirements are defined in a reasonable and objective way, due to the Constitutional Courts gives effect binding to its decisions. Os sistemas de controle concentrado de constitucionalidade italiano e espanhol têm características que os distanciam do modelo puro kelseniano e, ao mesmo tempo, permitem que se identifiquem com o modelo norte-americano de constitucionalidade de normas. A atribuição de eficácia vinculante nos planos horizontal e vertical às decisões constitucionais, ainda que não seja um elemento que identifique, de forma imediata, a jurisdição constitucional desses países europeus é, sem dúvida, um dos seus elementos caracterizadores, fazendo surgir, nesse contexto, a figura do precedente vinculante. Para que esses precedentes respeitem o princípio da igualdade na aplicação da lei torna-se imprescindível a definição de critérios objetivos e razoáveis para que as Cortes Constitucionais atribuam às suas decisões o efeito vinculante. L´ assegnazione della efficacia vincolante, in piani orizzontale e verticale, alle decisioni costituzionali, contuttoché non sia ancora un´elemento che li identifiche di forma immediata, è, senza dubbio, uno delle sue caratterische, facendo sorgere la figura del precedente vincolante. Ed, affinché, questi precedenti rispettano all´eguaglianza davanti alla legge, è imprescindibile che siano definiti i criteri obiettivi e ragionevoli perché le Corti Costituzionali attribuiscono alle sue decisioni l´effetto vincolante.
